Bad Shoot - Man Faces Manslaughter Charges

      You are correct but let me ask this. Did this guy (the guy that shot at the car) actually fear for his life? You don't know? I don't know either?

      I can only speculate as can you. I speculate he was startled and he fired at the retreating car in reflex OR because he just wanted to or he was in fear of his life Only he knows.

      Sometimes I think many here really look forward to using the guns.

      I hope mine rust to dust inside my safe never having to be used to defend myself or my family. (I'm going to suggest this be the new Snowflake montra)

        He felt threatened enough to pull the trigger. At least two intruders were on his deck. Your trying to tell me you would what, shout "I have a gun" and when they run away call the cops? What happens when they double back on you and beat you to death with the baseball bats they pulled out of the car?

        Reflex because he was in felt endangered? Probably. What I do know is he found at least two intruders on his deck where they had to climb up to get to and were obviously up to no good. It is NOT like they just walked up the drive to the front door to sell Bibles. Up to no good= threat in my book, and probably his.

        Sometimes I think that people need to stand up for whats right before throwing a homeowner, who was probably fast asleep, under the bus because he shot a criminal. When you are breaking the law, you have no rights. You have no right to expect not to get shot in the face when you sneak up on a mans deck in the middle of the night with the intent to rob him. Everything else is just crap.

            I don't think anyone is throwing the homeowner under the bus. The fact remains the guy will be charged and have to go through a trial spend thousands of dollars to defend himself and if convicted will do time and could loose his gun rights. That is independent of what we think is right or wrong.

            For me I use these threads and these events to try to better understand what I "might" do if faced with the same events. In my head I know i would not fire at a retreating or fleeing intruder outside of my home. I will gather my sheep and baracade inside and call 911. If they come back and break into the house with "baseball bats or guns" then all bets are off and I defend my home and family relentlessly.

            This is CA and for better or worse we will be judged by a jury of our peers. Those peers are from the liberal cess pool we call CA. So when you think you are going to get a jury who gives you a wink and secret "high five" from the jury box, you are kidding yourself.

              You live in a fantasy world if you think you won't end up in prison for shooting unarmed men who are fleeing. They didn't even have stolen property so you couldn't shoot them even in Texas.

              Back here in reality, the prsions are full of people who killed others because they perceived a threat that wasn't there. And your perceptions are certainly not the only thing that matters to LE, DA or Jury.

                  Do I feel bad for the "victims"? No.

                  Was it a bad shoot according to the law? Sure does seem so.

                  There's a small chance, in that state, that he may get away with just house arrest or maybe a year or two in jail. But he's lucky he's not in CA or NY.

                  At any rate, he should've known better. Very stupid decision.

                    Considering they fled simply because he confronted them, it sure seems like a good plan. This may shock you but if he had done this he wouldn't be in jail facing a manslaughter charge right now.

                            The law you are failing to understand is rooted in English common law going back centuries. It doesn't matter where you live, the justification for the killing of another human being is fairly uniform across the US as it is based off the Model Penal Code.
