Interfamilial Firearm Transfer Question

Hi, I was wondering if anyone knew from the DOJ point of view at what point a firearm is transferred using the interfamilial firearm transfer form?

I ask because my father has an AR-15 that he gave me, but with the nearing deadline for AR-15 ownership, I'm not sure if filling out the form and mailing it, is fast enough. Usually it takes about 2-3 months to get a reply confirming transfer, but is the technical transfer date, the date you list on the form? Or the date that someone at DOJ gets your form and enters it into the computer?

Would it be safer to just do a PPT?

Well, he actually gave it to me years ago, but I never got around to transferring it. Of corse, I haven't taken full possession yet, not until I have transferred it.

So you think if I do it via online they should honor the date of submittal? I guess i'll give it a go.

Transfers on long guns between parent, child and grandparent prior to year 2014, did not at that time require the op law form to be filed, so if you got it years ago, your done, now if for some reason your off on the date, and that receiver was entered in the CA DROS system post 2014, then yes it needs to be transfered to you.

I am transferring three lowers each to each of my Ca adult kids, and even though it costs more money I am going to private party transfer them I did three to my son yesterday.

Because I'm afraid of exactly what you are worried about if I do the upload transfer they may later come back and say my kids can't register them because they didn't have them in their possession until February the date the state processed it even though they would have had them in their possession this month even though the form was submitted in Dec. I'm just not willing to take the chance I'll pay the extra money for the private party transfer to them.

The OPLAW form and the on-line equivalent both document an already completed transfer; that's what the law requires: PC 27875(a)(3)

(3) Within 30 days of taking possession of the firearm, the person to whom it is transferred shall submit a report to the Department of Justice ...

There is no requirement to wait for any acknowledgement of submitting that report.

If it was before 1-1-2014 then nothing is required of you. You're done.

All that was legally required was Dad to say, "Son, I want you to have this Rifle".

No paperwork.

After 2014? Do the OPLAW and when it gets dropped in the Mail, you're done.
No need to wait for a reply. (Assuming you have the FSC card)
