I have an H&K SP89 that I want to sell, out of state. Do I need to complete that sale through an assault weapons dealer? Or am I better off going to Reno or LV and selling it on site at their gun show? Thanks for the advise.

If it is a registered assault weapon, an AW licensee must ship it.Expert firearms attorney: https://www.rwslaw.com/team/adam-j-richards/

Yes, it is a registered assault weapon. It is my understanding that I cannot sell it on the open market here in California? If I am wrong, please correct me. I've had it for years, along with the DOJ letter. I am selling it to fund another project. So if you know of any assault weapon dealers that have a permit to receive and ship out this firearm, I would appreciate it. It's my understanding that I can de-register this a/w, but frankly, I just want to sell it, along with the hi-cap mags etc. I don't have the patience at this point to jump through hoops etc. So again, I'd appreciate any information on a good way to handle this sale. Thanks again.Comment

KEEP IT
Do not let a RAW leave this stateComment

Registered AWs are worth their weight in gold in this state. You should keep it since it is not likely that you will be able to get another one any time soon in this state, if ever. No BB required and you get to put all the "evil" features you want on it.
ETA: If you do decide to sell it you should keep the receiver and part out the rest, this way you can build it back up at a later time.Oppressors can tyrannize only when they achieve a standing army, an enslaved press, and a disarmed populace. -- James Madison
The Constitution shall never be construed to authorize Congress to prevent the people of the United States, who are peaceable citizens, from keeping their own arms. -- Samuel Adams, Debates and Proceedings in the Convention of the Commonwealth of Massachusetts, 86-87 (Pearce and Hale, eds., Boston, 1850)Comment

I understand not directly to an individual due to feds. My second part was selling to a non-Californian through the out of state FFL.
In other words, he could line up his own buyer (which would be more profitable than selling to a FFL directly) then meet at the out of state FFL for the transfer.sigpicNRA LIFE MEMBERComment

You should not sell a reg'd AW in California. We need to keep those numbers high. They're unobtanium here and only worth $3K in the free world.
I assume your SP89 is a true registered assault weapon and that you filled out the special reg form and $20 fee, and filed it with DOJ by 12/31/00 - and that you got registration paperwork back from DOJ a few months later Spring 2001.
[If the above is not the case and you never filled out separate paperwork, and it's not a reg'd AW, you should remove all parts from the gun and strip it down to bare receiver. This at least prevents an ongoing crime, though it does not erase past crime of illegal possession - albeit threshold of proof has been raised quite a bit, esp if one keeps his mouth shut. If your SP89 were to have a fixed 10rd magazine installed with a Raddlock or other BulletButton-like attachment that makes a tool required for mag removal, then it is no longer an AW. If anyone asks you questions about when/where it was modified into now AW, contact a lawyer. DO NOT SAY ANYTHING.]
Registered AWs, if shipped from CA, must go (and return) via a CA FFL who also holds a CA AW permit. The charges are pretty high - $100-$200 last time I heard, and the permittees are few & far between.
Registered AWs can be driven to/from CA for vacation, etc. You could drive your reg'd AW out to NV and sell it to someone there (thru an FFL, of course - direct person to person sales are generally illegal when crossing state lines.)
If your registered Category III AW SP89 were to have a fixed 10rd magazine installed with a Raddlock or other BulletButton-like attachment that makes a tool required for mag removal, then it is no longer an AW for purposes of transport/gunsmithing etc - even though it is registered as an AW. It can then be shipped like a normal handgun outside CA to an FFL dealer.
Edited to add:...
Good.Originally posted by phatom24Yes, it is a registered assault weapon.

Generally, yes.
However, you could render it into non-AW status thru a Bullet-Button like devive, de-register it with Calif. DOJ and then sell it to a Californian via PPT (thru a CA FFL) as a non-AW. That person would always have to run a 10rd fixed mag in CA , yada yada yada...
Oh please don't. Other projects are not worth it. Save your pennies, buy instant coffee instead of Starbucks, etc.I am selling it to fund another project.Last edited by bwiese; 01-27-2009, 7:42 PM.
