If it bothers you, after you pick up your rifle, mention your assumption to the owner. See what he says. If you're correct, you're basically paying tax to the FFL instead of the government. Personally, I'm ok with it. You win because you're able to get the rifle you want (and probably at a good price) and he profits/stays in business. You don't have to do business with him in the future if it continues to bother you

The use tax on out of state purchases is about 90 years old, and it covers everything, not just guns. The tax board recently got the idea that guns transferred from out of state were easy to enforce tax code on, as there is a record of who is getting them.Never initiate force against another. That should be the underlying principle of your life. But should someone do violence to you, retaliate without hesitation, without reservation, without quarter, until you are sure that he will never wish to harm - or never be capable of harming - you or yours again.

Best to change your thread title to something like "Help me understand why I am paying tax on my transfer"
That way you are not giving the FFL a bad rap. He's doing things the way he is supposed to. . . . .sigpic

I had this happened to me on a out of state transfer. The pawn shop marked it as used and charged me tax. Went again to restart the DROS the following day. I also figured they marked it used to pocket the cash.

Some FFLs may mark guns as used if they didn't purchase it for the store inventory from a distributor. Since his invoice has tax on it, I doubt he's pocketing the money.Never initiate force against another. That should be the underlying principle of your life. I've had 5 different FFLs collect sales tax on used firearms receivers/guns from out of state. The sale is no longer considered a PPT and it's treated like any other sales purchase. There policy is either wrong or they will owe CA some money whenever the State figures it out.Originally posted by COINTELPRODug this up-
From AmmoBros current transfer FAQ:
"Transfers
FFL Transfers are firearms shipped into an FFL from another location. They can be shipped from either another dealer or a private individual.
FFL Transfers MUST Be CA Legal. Handguns must either be on the CA DOJ Roster of Approved Firearms or be exempt from the roster.
Fees
Incoming FFL Transfers are $75.00 + $25.00 DROS (CA Background Check) + CA Sales Tax. All transfers from FFL dealers must have a CA Firearm Shipment Approval number. Any firearm received without an approval number will be returned at the buyers expense. Transfers from private individuals are exempt from CA Firearm Shipment Approvals and CA sales tax. All firearms received from a private individual MUST have a clear copy of the sellers ID included in the box."
NOTE: This is not their PPT policy. This is out of state transfer from an individual for an item such as a used rifle.
My invoice does not list a dealer name or address. Simply "no invoice" and USED listed on the DROS.
I could very well be wrong, but it leads me to believe the "tax" money collected was pocketed.
No interest in keeping someone with these morals in business, such as the "rather give it to them than CA" belief. FFL or not.
99.5% chance the money is not being pocketed.

All FFLs collect sales tax on out-of-state purchases unless the tax was paid at the time of sale from the vendor. It's been like that for quite some time.sigpic
