    AW lower / 22lr upper question help

    What if my dad died, and while cleaning his estate, I found a PWA lower half completed with a 22 upper attached. Would it be legal for me to complete the lower and enjoy or would I have to sell it out of state? Would transporting it be illegal?

    First you say the lower is completed, then ask if it's OK to complete the lower. So which is it?

    PWA is banned by name. But it's an interesting question if it'd be allowed since it's built into an exempt rimfire.

        I'm sure if the lower is banned by name, nothing you can do but destroy it. I believe it's non transferable.

        Upper, buffer tube and trigger components totally fine.

          Even if it isn't exempt, it doesn't need to be destroyed. He can simply take it to an FFL and have the FFL sell it out of state.

          Or, if he has family out of state, he can send it to them for safe keeping. It's his inherited property after all.

          If he has a second home out of state, he can have it shipped there.

            Yes, it seems to be an evil lower by the PWA stamp, but isn't that void if it is a dedicated rimfire after all there are plenty of other companies put name stamps on lowers to make it there own. After all it is just a machined piece of metal.

              OP, I suggest posting a new thread with a better title. This thread isn't getting the looks. I'm sure some Calgunner can answer your question.

              Something like "I inherited an AW. Can I keep it?"

              Then in the body of the post, point out it was built up as a .22 LR. Ask if it's exempt as a result.

                1. This question would have been better served in the "How CA Laws Apply to/Affect Me" subforum.

                2. You're out of luck. All PWA models are banned by name under California PC 30510(f) and 11 CCR 5499(a), making them Category 2 assault weapons. Only Category 3 AWs (i.e., those defined by PC 30515(a) features) benefit from the rimfire exemption.

                  There is no rimfire exemption to make/model banned assault weapons. [PC 30510]

                        Yes. But you can only use 10 round mags next year.
