Open Carry While at Home

    Open Carry While at Home

    So lately I have been open carrying when I am at home. I have gotten real comfortable with having my side arm on all the time now. I do have a quick question tho. I know I can open or conceal carry while both inside my house and in my fully gated backyard but can not carry in my front yard since there is no gate or fence around the front of my house. I love to work in my garage and during the winter months I have the garage door closed but now that it is hot as heck in the Inland Empire I would like to open my big garage door that faces the street BUT if I do there is no barrier between me and the public domain. Could I be arrested for carrying in my garage with the door open? Also is there a law that states I am not allowed to have my holster on when I go to the store with NO firearm in it? This is for those times I need to leave the house to get parts or lunch.

    I don't see a problem with open carrying while you're in your garage nor having an empty holster while you're shopping. You might get some weird looks from people, but that's their problem.

      Why would you openly want to do something that would call attention to yourself?
      Unless you know your neighbors well enough that they would not freak out at the sign of a gun . . . . . If one of them should call the police on a "man with a gun" call you know as well as I do what is going to happen.
      I am not familiar with your home location nor if you are located in a rural or urban setting.
      This is California after all . . . .
      Common Sense is your most logical solution to your question.

            Well I do live in the city of Riverside (not a rural) area. I am not asking if neighbors would freak out. I get the no need to advertise or calling attention to my self. I do try to always have one of my big shirts on that usually covers the side arm but there are times I dont. I dont have a concealed carry holster so it is on my side in the open but for the most part under a shirt. I am asking about the legally is it good to go to have the garage door open. No I dont know most of my neighbors.

              I was told that you may open carry until you arrive at the "public" sidewalk or street at the end of your property line. But why would you want to expose yourself? A CCW is both a priviledge and the best way for you to carry and feel comfortable.

                I know the law on this^^^^ you can only carry open or concealed on your property without a permit as long as the your property where you are carrying is either fenced off or walled off from the public. There has to be some type of barrier between you and the public so that stupid people know exactly where your property is and do not pass into it mistakenly. Since I have neither a wall or a fence in the front of my house I do not go in the front yard.

                  FYI.
                  If part of it is concealed, then it is considered concealed carry not open carry.

                    If the garage door is open, you do run the risk of being arrested for open/conceal carry and having a loaded firearm in public.
                    Open door equates to open to the public.


                    There are no CA laws that prohibits a person from wearing an empty holster.

                      Maybe you answered your own question. Assuming the property has the garage facing the front of the house and street, opening the garage door removes the barrier.

                        What? Walking around stores with an empty holster is a look at me sign, and its not going to be "their" problem are constantly explaining to coos that its just an empty holster.

                        To me, this is as silly as wearing a CCW vest as you carry.

                          Thus, if no front fence, the garage door is open, and the door from the garage entering into the house is open = one can no longer carry within one's house...?

                          or

                          no front fence, front door into house is open = one can no longer carry within one's own house...?

                              Granted I have my CCW, but I know for a fact my gun has revealed itself countless times while working in the front yard and nobody has seemed to care in my 3 years at this house. My neighbor open carries his Glock 21 all the time in his garage, nobody cares... he does have a knee high fence across the threshhold of his garage to keep his dog in... maybe try that to stay within the letter of the law when the door is open...
