    RAW Transfer (CA to AZ)

My dad is coming to visit my family here in Arizona tomorrow.

He owns a registered assault weapon (AR-15) but no longer wants it. Does he have to do anything special to transfer it to me or can he just drive it over and let me have it?

Here in AZ we don't require FFLs for transfers or sales of firearms, if that matters.

    Thanks!

He can transfer it to a resident out of state, but it must go through a FFL in AZ if that is where you live. Transfers between residents of different states must use a FFL, no exceptions for family.

AZ law doesn't require FFL for transfers between two residents of AZ, but federal law requires FFL for transfers between residents of different states, even if they meet face to face for the transfer in AZ. 18 USC 922(a)(5), it's a felony.

I believe OP is in AZ, and is asking if his dad can take it there and transfer to him.

For the last 47 years, Federal laws have prohibited the transfer of firearms between residents of different State unless it is done through a FFL.

In order to comply with Federal laws, the firearm must be transferred to you through an AZ FFL dealer.

Failure to utilize a FFL dealer equates to a Federal felony for your father and a Federal felony for you.

There is no family or gift exemption to the Federal laws.

In a free state, he can buy any brand lower he wants.

The replies here are making my head spin.

The right answer is here, but other things are 'noisy'.

Already noted: Dad cannot just 'give' it to you in AZ; Federal law requires an FFL handle the CA-resident to AZ-resident transfer.

Also already noted, AZ law on transfer among AZ residents does not apply here; it's Federal law one must follow for interstate transfer.

This is one of the few cases where it might make sense to use the CA No Longer In Possession form, to get that RAW off his ownership record.

Frozen in 2015, it is falling out of date and I can no longer edit the content. But much of it is still good!

Your dad in CA should have it sent to Az thru the proper FFL. He will need the paperwork from the FFL here in CA to send to the CA DOJ to have the RAW removed from his list of RAW's.
Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.

                BS. All of it.

                1) His Dad can take it to AZ, if he wants. FFL in AZ can do the PPT.
                2) Librarian nailed it on the no longer in possession form. You don't need anything but your written affidavit. I've done it.

I did mine from CA ffl to Missouri ffl. Then filed the no longer in possession form the the DOJ. I did as DOJ told me to do. No issues. No BS.
