    DEPUTIZED...?

    Hi All,

Is there such a thing anymore? I've seen first hand experience, of goat ropers deputized to muster an extraction/dispersion in Yosemite Valley in the '70s.

In a hypothetical SHTF, could residents of a city/county be deputized and have the same fire arms access as LEO readily available? No BB, high cap mags? Just curious. PAX

    Check 150 PC.

Possible, but not likely. Too much liability.

    150. Every able-bodied person above 18 years of age who neglects or
refuses to join the posse comitatus or power of the county, by
neglecting or refusing to aid and assist in taking or arresting any
person against whom there may be issued any process, or by neglecting
to aid and assist in retaking any person who, after being arrested
or confined, may have escaped from arrest or imprisonment, or by
neglecting or refusing to aid and assist in preventing any breach of
the peace, or the commission of any criminal offense, being thereto
lawfully required by any uniformed peace officer, or by any peace
    officer described in Section 830.1, subdivision (a), (b), (c), (d),
    (e), or (f) of Section 830.2, or subdivision (a) of Section 830.33,
who identifies himself or herself with a badge or identification card
issued by the officer's employing agency, or by any judge, is
punishable by a fine of not less than fifty dollars ($50) nor more
    than one thousand dollars ($1,000).

Technically yes. But now a days, hell would freeze and thaw twice over before you get deputized.

Yes it can happen, and if it does, it will be VERY QUICK for a very specific reason. The department is taking on a huge responsibility in deputizing a person who is an unknown.

As a volunteer with my local Sheriff department, the discussion has come up a few times, and the department P&P is discussed and known, so if the need arises, we know how, and what our scope of responsibility is.

But a volunteer off the street? Highly unlikely.

If so, it would likely be perhaps in a situation like a lone officer struggling with a suspect and asking for the assistance of a bystander. For that brief period till the suspect is secured or backup arrives or whatever.....technically/legally speaking you're acting under the authority of the LEA who enlisted your aid.

But the notion of being asked to arm up and go kick in doors or be part of a manhunt or something ain't gonna happen these days. It just ain't.

I assisted an officer a year ago yesterday and was not deputized under the same circumstances as above.

IMHO, EVERYONE has a duty to come to the aid of another who needs it and asks for it, LE or other. It's just the human thing to do.

Not sure what you mean by that?

If you were asked to assist, the act of asking for your assistance technically "deputized" you for that brief period of your assistance. It does not require someone actually saying "I deputize you".

I witnessed the officer on the ground wrestling with a suspect, I pulled up and asked if he required assistance. He affirmed and I assisted in subduing and cuffing the suspect. I also offered testimony to the DA. I was never deputized in any way shape of form. Just a helpful citizen assisting LE in arresting a ADW suspect.

In functional legal terms, I would say that you actually were.
