Got a Delay on my DROS, then an Undetermined, after waiting 65 days. Took the next step, a Live Scan, and now I must wait another 90 days.

My question: Is it appropriate to ask an FFL if they would honor an Undetermined status and let me buy my rifle?

I'm new to buying in California (sheesh) but not new to gun ownership (like all my forebearers) and... I've had two previous Live Scans (BTW, I'm OK to teach in California).

I doubt an FFL would allow you to purchase a rifle. I could be wrong, call around and ask.

It's FFL's choice to let you have it. Definitely worth asking.

Assuming you've paid for it, yes, they can release the firearm to you on an undetermined status.

Appropriate? Yes, why did you wait 35 days past the DROS limit for pick up? Now at the least you have to pay the DROS extortion to Commyfornia again, before you can exercise your inalienable right.

You should always ask up front about FFL releasing on undertermined status. Because it is their choice. If they say "No Go". Tell them to lick your nether regions as you walk out of their establishment.

Always check the FFLs policy on undetermined status BEFORE you buy. They can legally release it to you on undetermined, but some will not do it.

Do not let them hit you with a restock fee if they will not release it.

I will call around, fingers crossed, and find a FFL willing to check me out and allow me the >courtesy< of practicing the same birthright as my forefathers.

From an FFLs perspective you are highly unlikely to find anyone willing to release the rifle to you without knowing you personally. The issue came up three times at my last shop. One was family of an employee, at 75yrs old we figured she was a safe bet and released the firearm. The other two I declined to release and they both turned out to be felons, who didn't remember until after they got a livescan back.

Call DOJ and find out why you came back undetermined.

I disagree.

Most of us FFL'S have a policy in place for undetermined. We will either flat agree to release or flat refuse to release. Picking and choosing leaves you open to someone crying discrimination.

Op, call around, many of us release on undetermined as a policy.

Smells fishy. Op says he has had 3 live scans all together and still comes back undetermined.!! Something is not right here.

Why don't you (OP) look into it and fix your status with the DOJ ???

There is nothing fishy about it. The DOJ is more than capable of botching up a DROS for no good reason. I had two DROS's approved and the third time up I was delayed and then switched to undetermined, but I had a dealer that still delivered. Many will not. I ran a live scan, the results of which were negative, and then checked with the DOJ as to why I had been delayed. They couldn't tell me why, but apologized and gave me a contact to call if it happens again.

But a different piece of data about him that is unique to him and him only. Go clear it up once and be done with it. Most people i know would do that over sweating every time they want to buy a gun.
