    Non-Resident selling gun in CA

    Can an out-of-state resident visit CA, and sell an off-roster gun to a CA resident?


    Nothing weird about it, not a straw purchase or anything.

    Yes, as long as it is on the roster if it is a handgun, or if some exemption from the roster applies. You must use a FFL and not be a prohibited person. The most difficult part will be finding a FFL who will accept a firearm directly from a non -resident. This will not be treated as a Private Party Transfer, as those are between residents of CA.

          OK thanks guys. I have some interest in my XDs that I was trying to sell for a million years, and the minute I move to TX everybody in CA wants it.

            If you haven't completed the move to TX, and you still have a CDL, you might be able to sell an off roster handgun via a Private Party Transfer. You will have to be physically in front of the FFL as a PPT is a face to fact transfer. Is the move complete and what has been done as far as change of residence? Have you started work in TX?

                I've been working in TX for awhile now but haven't gotten off my arse to get a DL.

                Which is disappointing considering I'm missing out on a lot of good deals and my LTC.

                Shield 9 has been on sale at PSA for $349 2 or 3 times now!

                  That's true (only for PCS orders though), but then they would not be an "out-of-state resident" as the OP's question poses.. Such folks are deemed California residents for firearms transfer purposes. Please refer to 18USC921.

                    Regardless of having a Ca DL still, it would not be wise to attempt to do a PPT in Ca with that DL. There are a host of issues that could come from that and none of them are good. Go get your Tx DL and try to forget the BS you had to deal with here.

                        Only Federal agents and California Congressmen can sell illegal guns in California and get away with it. Little people aren't afforded that privilege.

                          I heard of a guy with a California ID card with his parents address on it. He actually lived/slept in another state. It was an odd thing - I thought.

                            yeah my ID still has my parent's address. Going to get my TX DL this week. I'm not going to chance it, not worth it to me.
