Ok so they are saying the FBI is understaffed and overwhelmed with the number of background checks. That also demonstrates that universal or expanded background checks to include private transfers would make no difference because they can't even handle the increased sales now.

I'm wondering about the clean record people being declined due to them being short staffed? Couldn't some one (who has the money and time) file a lawsuit?

Met a guy who was denied so any times they had to make a special account for him at a local gun shop. He was buying stuff left and right (old timer with money) and getting denied like every other time. I think it had something to do with his name being similar to a few others on the "do not sell" list. That was like 4 years ago if I remember.

I'm so glad I'll be exempt from NCIS checks once I move out of CA. I have never been delayed yet though even though I have a common name.

I have never met any one who was all clean of legal problems and denied or delayed. I mean one honest enough to tell the whole story. I shoot with at least 150 calgunners at several different ranges. Neither me nor any of these folks has ever had a delay in Dros (Knock on wood). Last couple of shoots I went to, I saw at least 20 new guns from members there. All after San Berdo and all cleared like normal.
If you have ever drosed a gun and passed, it is going to be the same next time and for ever unless if you do something funny or legally significant in between. Yes, an arrest for Wacky Weed is significant even if you thought you over paid for the stuff and there was only a little bit there, same as slapping your wife and having a police report on that, and countless other stuff if there is a report. It does not have to be a Felony.
Now, If you are delayed or denied on your first gun and you are abso-frigging-lutely positive that you have never had trouble with LAW, there is a process to clear your name once and for good.
Let us know what your hold was for and how it was cleared. Pissing and moaning here will not speed up the Feds or anybody else.

Some individuals incorrectly denied may feel intimidated by the appeals process or simply dealing with the federal government in this capacity. In her book, Brady Denial? You CAN Get Your Guns Back!, Attorney Cindy Ellen Hill, who has helped clients navigate the NICS denial appeals process, writes, “people who don’t appeal their Brady denials make that choice based on a lack of information, lack of money to hire a lawyer or investigator to assist them, or out of fear of drawing further unwanted attention from federal and state law enforcement authorities.”

That article is about denied checks that have been appealed. A NICS check usually is only a minute or two. It's computerized so the number of FBI employees has nothing to do with it.
