    Selling rifles and the limits

    I buy a lot of rifles, most of them never even get shot, and then I end up selling them. Looking back over my sales this year, I've sold five. I can't believe I sold that many, but if I'm not going to shoot it I don't bother keeping it.

    I'd like to sell one more rifle, but I can't really get a definite number on the limit California imposes on gun owners in this state. I know five handguns is the limit, but for rifles, it just says infrequently. That isn't very helpful.

    BATFE is the one that imposes a limit of 12 per year. Any more than that and they'll think you're making a living at selling guns without their blessing.

      Do you have a link to where ATF says 12 long gun sales a year max for a non FFL?

        So what you're saying is that six in one year isn't a problem? I don't want any Bearcats crashing through my front door because I went over the max.

          I haven't seen BATFE's ruling that 12 is the number; might be so.

          CA, as you note, says that rather vague 'occasional and without regularity' at PC 16730(a)(2). No hard number.

          The news stories that appear with such a charge against a seller seem to involve dozens-to-hundreds.

              One suggestion would be to call your local field office and ask to meet with one of the Special Agents to discuss. Getting some face time with those guys never hurts. Let them know that you want to know what might set off red flags for them, and let them know that you don't want to do anything that they deem sketchy. We do pay taxes to float their Agency, so may as well use them as a resource.

                Please provide some sort of link or documentation to support your claim. I've never seen anything that would even hint at a 12 gun limit. BTW, ATF wouldn't care about "making a living" or not. They wouldn't care if the seller lost money on each one. If there is a limit, it has little to nothing to do with "profit". They wouldn't care if you had a good business model or your business lost money.
