    Handgun Safety Certificate -Transfer

    Hi Guys,

    My HSC card has expired (within the last two weeks) and will be transferring a handgun into my name from another person. My question is, will i have to take the HSC test again to transfer the handgun into my name? Or is the HSC card only needed when you are purchasing a handgun from a dealer?

    Yes you need to take it again, but this time is called FSC and includes rifles/long guns.

      The HSC is being phased out and is being replaced by the FSC.

      A FSC is required to obtain any firearm in CA. [PC 31615]




      Penal Code 31615
      (a) A person shall not do either of the following:
      (1) Purchase or receive any firearm, except an antique firearm, without a valid firearm safety certificate, except that in the case of a handgun, an unexpired handgun safety certificate may be used.
      (2) Sell, deliver, loan, or transfer any firearm, except an antique firearm, to any person who does not have a valid firearm safety certificate, except that in the case of a handgun, an unexpired handgun safety certificate may be used.
      (b) Any person who violates subdivision (a) is guilty of a misdemeanor.
      (c) The provisions of this section are cumulative, and shall not be construed as restricting the application of any other law. However, an act or omission punishable in different ways by different provisions of this code shall not be punished under more than one provision.
      (d) This section shall become operative on January 1, 2015.

          Valid hunting license is only an FSC exemption when acquiring a long gun. [PC 31700(c)]

          A FSC is still needed to acquire a handgun.



          Penal Code 31700
          (c) A person, validly identified, who has been issued a valid hunting license that is unexpired or that was issued for the hunting season immediately preceding the calendar year in which the person takes title of possession of a firearm is exempt from the firearm safety certificate requirement in subdivision (a) of Section 31615, except as to handguns.

            Hunting license will exempt you for Long Guns but not Hand Guns.
