FFL transfer direct to me?

So I sent my action to a guy to do my stock. He has a FFL. The guy who did the stock then sent it to my gunsmith who chambered the barrel. He is also a FFL.

The gunsmith is telling me he needs to send it to a FFL because the action did not come direct from me.

Is this right?

The SN# did not change and the firearm was not converted or changed into another firearm.

yes, they are correct, he can either return it to 1st FFL or DROS it to you.

If they FFL has had the firearm for over 30 days, he must also DROS it back to you.

so the answer depends on how long it has been out of your possession. if more than 30 days, have the 2nd FFL DROS it to you. if not, have him send it to first FFL and have First FFL return it to you.

but under no circumstance can second FFL just give it back to You

yes, The first FFL is also supposed to DROS it back to you if it has been out of your possession for over 30 days. This often causes a problem for off roster guns...at which point the best cause of action is for him to log it out of his book, to retun it to you, and relog it into his book, before the 30 day mark passes....

Never heard of this 30 day thing with a gunsmith. Plenty of rifles get built by gunsmiths over 30 days and are returned directly to their original owners without dros so long as the owner already owned the action as in this case.

The first ffl should be able to send it back, but I'm no expert

have the second FFL sent it back to the first FFL and then the first FFL can do a no-DROS gunsmith return back to you. the first FFL received it in for gunsmithing and can return it without needing to DROS. the fact that the first FFL sent it to another FFL for additional work is not an issue as long as it comes back to the first FFL to the return back to the owner.
