    Multi-State Acquisition of Off-Roster Firearms

    So I've read about 25 threads on the subject of acquiring off-roster firearms and residency and I couldn't help but notice the intentional FUD in some of the threads rather than answering the question of how one can 100% LEGALLY own an off-roster weapon.

    A few are clear (all through FFLs):

    1. Gift from parent / child (Good to go)
    2. Inheritance (Good to go)
    3. PPT via LEO or other CA resident. (Good to go)

    The one I found most interesting was "dual" residency so I came up with a different scenario. Here's the background:

    Joe, 35yo, US Citizen and military veteran hit the lottery ($288M) in the year 2000. Joe meets ALL requirements for legal ownership of firearms in CA, OR, ID, NV, UT, and AZ.

    Joe is not registered to vote in any of the 50 States as he never had much of an interest in politics.

    Joe owns a home, a business, and a car in each of the aforementioned States outright - no mortgage, car loan, etc. He pays real estate taxes, utilities and other home ownership expenses automatically from banks in each of the respective States.

    Joe hates paperwork, he keeps his money in various banks (one in each State) all in non-interest bearing accounts. He's already wealthy so he doesn't care about interest.

    The remainder of his significant wealth (more than 50%) is overseas. He has citizenships in multiple countries.

    Joe is not married and has no children.

    Joe has no job, no income, no pension and does not owe any money to the Federal government so he has no Federal or State taxes to file.

    Joe has an International Driver's Permit and multiple passports as he is a citizen of more than one country. He has a driver's license from Oregon, but that's the one State where he doesn't spend more than a month a year.

    Joe's vehicles are registered in each State in which he owns a home.

    Joe has no professional licenses.

    Other than his mortgage, insurance, taxes and utilities which are paid by his bank accounts in each state automatically each month, he prefers to pay for all his other expenses in cash.

    Joe has a credit card from a bank in each state, but has $0 balance as he prefers paying cash.

    Joe is not religious and does not attend church in any State.

    Joe has family and friends in each of the aforementioned States - he's really popular - his wealth may have something to do with it.

    However, he is not a member of any social or country club.

    Joe's investments are in each of the respective States and in several countries overseas.

    Joe doesn't like doctors much, but he does have a doctor in each State as a convenience. He also has an accountant in each State, but that's just to make sure the bills are getting paid.

    All of his attorneys are only familiar with the laws of their respective States and advise Joe that they cannot give legal advice with regards to States where they have not passed the Bar exam. Besides, like doctors and other professionals, Joe doesn't really like attorneys so he has as little contact with them as possible.

    Joe really likes his lifestyle as it is and for the past 15 years he has split his time equally among CA, OR, ID, NV, UT, and AZ and considers each his "home" - on average he spends about 6 weeks at each home and the rest of his time is spent on the road in other States or overseas in multiple countries.

    Joe's main hobby and interest is firearms. He always carries a lot of cash and has CCWs from each of the aforementioned States (he's quite aware that some overlap).

    He is the legal owner of hundreds of handguns. He really, really likes handguns.

    Joe's CA CCW is expiring and has to be renewed. So he would like to put 3 handguns on it. His 3 favorites:

    1. A Glock 43
    2. A Walther PPS
    3. A Ruger LC9S Pro



    One of Joe's anti-2A Sacramento, California neighbors / "friend" tells Joe,

    "Well, sorry Joe, but you bought that G43 in AZ, that Walther PPS in NV and that LC9S Pro in Idaho or was it Utah? (Joe doesn't remember exactly which State) - so you can't bring any of them into CA and register them here so that you can CCW those firearms here.

    You have to buy a CA firearm that's "on the roster". Joe objects saying that those are the firearms that he carries in OR, ID, NV, UT and AZ and given how much he travels across all these States (incl. CA), and wants to figure out a way to do this legally.

    Joe does not want to purchase the same guns over again on Calguns.

    Joe's twin brother, Tom, who also has CCW for all these States ran into a bad patch these last 2 years and is homeless - owns nothing in any State and hasn't had any money for 3 years. He lives out of one of Joe's old cars registered in CA and his CA CCW is about to expire and has to be renewed.

    Joe will not give any money to Tom except for the renewal of his CCW so that he can protect himself during his homelessness.

    1. Can Joe legally carry his guns in CA? If not, what does he have to do to LEGALLY register those EXACT guns in CA?

    2. Can Tom renew his CCW or will his homelessness and "lack of connection" to California mean that he will lose his CCW?


    Please do not inject FUD by quoting and highlighting parts of California law. If you're going to quote something include the whole text of that section - don't cut off the parts of the sentence that says, "unless...." or "except...", etc.

    I ask that you please only contribute to the achievement of the goal - that is, Joe LEGALLY owning and carrying his own firearms in Sacramento, California.

    If you don't know or don't have suggestions on 100% LEGAL solution to the inquiry above, please do not contribute a FUD response.

    The intent is to follow the law as it is written today (not as it may be next year).

    Please skip the "consult a lawyer" line. Joe already knows he can consult a lawyer if he wanted to talk to one and Tom is too poor to do so.

    Please save your "troll" comments and direct those frustrations elsewhere. It is legitimate dialogue. Noone is holding a gun to your head, you don't have to participate.

    Last I checked, the 1st amendment still applied in this country - yes, *gasp*, including California. Joe will apply for his 1st amendment license as soon as the applications start flowing.

    Yes, yes, this forum is monitored. Fantastic. The State will just use this information to further its gun control objectives - fine. In my view, that tightening of the noose may just be what is needed for more people to raise the issue of gun rights in the State of California.

    With that said, lets begin.

    Speculation on multi-state residency can go ONLY to 'ask a lawyer'.

    Non-lawyers, even lawyers who are not specialists in the area, cannot possibly address non-California residency/citizenship.

    Since you don't want that answer, closed.
