    Hypothetical scenario: Legality?

    Hypothetical scenario:

    Lets say I buy 10-50 lowers from the same vendor and have them shipped to my FFL. I pay one DROS for all of 'em, I then turn around and PPT them for $35 each (+ the cost of the lower, etc.) to various friends /family (all legally able to own firearms of course). Is this legit and legal?

    Whats the magic number of longguns I can transfer before the big red light goes on in Sacarmento?

    I ask because this may be a way to buy a bunch of lowers and get them into the hands of Californians legally at a reduced rate and not have everyone pay the DOJ extortion fee.

    I might be wrong (and it may only apply to handguns), but there's a limitation of 5 PPT sales per year, unlimited firearms per sale though.

      They would all be paying the state extortion fee. $25 of the $35 for the PPT is the DROS fee.

        Probably not a wise idea.

        I've heard of people buying 10+ receivers getting a call from the ATF. Plus, by reselling them, you are acting as a dealer, and would need an FFL. Hell, CADOJ tried to roll up artherd (IIRC) as a dealer for fronting the money on a group buy. They never even were transfered to him, were always on an FFL's books.

        As for number sold, there is no majic number before they pop you.

        12070. (a) No person shall sell, lease, or transfer firearms unless he or she has been issued a license pursuant to Section 12071. Any person violating this section is guilty of a misdemeanor.
        (b) Subdivision (a) does not include any of the following:
        (4) The infrequent sale, lease, or transfer of firearms.
        (c)(1) As used in this section, "infrequent" means:
        (A) For pistols, revolvers, and other firearms capable of being concealed upon the person, less than six transactions per calendar year. For this purpose, "transaction" means a single sale, lease, or transfer of any number of pistols, revolvers, or other firearms capable of being concealed upon the person.
        (B) For firearms other than pistols, revolvers, or other firearms capable of being concealed upon the person, occasional and without regularity.

          like everybody else said, that isnt such a hot idea as that could be too many PPT's for you to be doing (without being a FFL). I dont get how that is supposed to reduce the DROS fees, though. If you have a group together that is all interested in buying, maybe you should call one of the local OLL ffl's and organize a field trip with your group.

            I don't know of a state "Magic Number," but buying a serial numbered part in quantity and reselling would probably be viewed as engaging in business by ATFE, and you'd better be a licensee.

              With long guns, keep the number low and you should be fine. More than 10 a month might pop a flag.
