    Hi Cap Magazines?

    Can a person who has two legally owned pre ban hi cap magazines carry them out of state and return with them? I have a friend who wants to do that if it's legal. Thanks.

    It depends on when he/she acquired them.

        My understanding is that it is perfectly legal to do that. The only thing is if she is stopped on the way back and they are discovered is the LEO going to believe her? My guess is probably not.

          Generally... standard capacity equates to what the manufacturer designed it for and high capacity equates anything over what the manufacturer designed it for.

          Which means there are "standard capacity" and "high capacity" magazines that can be legally made/imported/bought/sold in CA, because they are not classified as large capacity magazines under CA laws/regulations.

          Therefore, when discussing legal issues involving magazines, use the correct legal terminology.

            If the person legally owned/possessed the large capacity magazines in CA before 01-01-2000, then they can legally take them out-of-state and bring them back to CA. [PC 32420]


            Penal Code 32420
            Section 32310 does not apply to the importation of a large-capacity magazine by a person who lawfully possessed the large-capacity magazine in the state prior to January 1, 2000, lawfully took it out of the state, and is returning to the state with the same large-capacity magazine.
