    Do I need to do anything?

    Had a real bummer happen this week. I had sent in my TriStar Viper shotgun to TriStar for repairs (this was after several tries to get it right). I called them back to find out where it was and was told that it had been shipped to me. They had apparently shipped it to my old address in CA, rather than here (where I shipped it to them from the last couple times it went for repair). Followed up with them, and it turns out that UPS dropped the package on the front porch of my brother's place without collecting a signature (because nobody was there!). Well, as usual for Fresno, something left out exposed grew legs and disappeared.
    Tristar is replacing the gun, which is great. The question is, do I need to report the missing/stolen gun to the police in Fresno? Or is this something that UPS will end up having to handle?

      I can't believe UPS, Fed Ex and even USPS hasn't started Red Lining less than excellent neighborhoods for Do Not Drop Off.

      I'm even surprised they don't have some No High Value Drops even for great 'hoods like in Los Altos, since we got a decent number of door to door semi-shady types and lots of homes you can eyeball any packages from the sidewalk or street, and Lord Knows in high price 'hoods often both adults are actually out of the house 12+ hours a day busting *** at hard professional careers.

      IMO the Drop At Door Regardless needs to be an option you must request and release the carrier from any responsibility.

      They should also upgrade to an instant automated call AND email AND text once package is dropped.

      Back in the day my roomie was an FFL and he'd have UPS dropping guns AND ammo for the same guns all the time and nothing ever happened. Sure it was Professorville in Palo Alto but still, I was like "bad thing waiting to happen" and "how can that be legal or policy?"

      I guess Xtmas came early this year in the slums of Fresno. My Fresno contact says the whole city has been overrun with insane numbers of fresh illegal gangbangers. He says "When LA is full, the Illegals come to Fresno".


      PS-HELL YES CALL THE COPS LIKE RIGHT NOW. CALL 911 so call is recorded just to extra CYA. If this gun is used in a crime and you say "well, it was stolen from my bros but I hadn't called Five-Oh" I wouldn't put it past the cops to figure this is a new scam to get guns into the hands of your gangbanging buddies while you also commit insurance fraud squeezing an extra gun out of the manufacturer.

      PPS-cops may want you (or bro) to make the report IN PERSON in Fresno (not 1" outside city limits either, lol) but call NOW (might only get non-emergency number since 911 will be local to your area in TX), and have bro call in he is in Fresno.

        Guess so, though where it was taken is one of the nicer areas of Fres-hole. Hadn't had anything taken from there in 20 years (till now, I guess).

            Also report it to the BATF&E because by law ALL common carriers are suppose to get a signature when delivering firearms. We have to get them to follow the law and stop all this aggravation.

            Basically once you tell the clerk that a firearm is in the package they are suppose to make sure "restricted delivery adult signature required" is required to be added prior to accepting the package for delivery.


            27 CFR
            478.31 Delivery by common or contract carrier.

            (a) No person shall knowingly deliver or cause to be delivered to any common or contract carrier for transportation or shipment in interstate or foreign commerce to any person other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector, any package or other container in which there is any firearm or ammunition without written notice to the carrier that such firearm or ammunition is being transported or shipped: Provided, That any passenger who owns or legally possesses a firearm or ammunition being transported aboard any common or contract carrier for movement with the passenger in interstate or foreign commerce may deliver said firearm or ammunition into the custody of the pilot, captain, conductor or operator of such common or contract carrier for the duration of that trip without violating any provision of this part.

            (b) No common or contract carrier shall require or cause any label, tag, or other written notice to be placed on the outside of any package, luggage, or other container indicating that such package, luggage, or other container contains a firearm.

            (c) No common or contract carrier shall transport or deliver in interstate or foreign commerce any firearm or ammunition with knowledge or reasonable cause to believe that the shipment, transportation, or receipt thereof would be in violation of any provision of this part: Provided, however, That the provisions of this paragraph shall not apply in respect to the transportation of firearms or ammunition in in-bond shipment under Customs laws and regulations.

            (d) No common or contract carrier shall knowingly deliver in interstate or foreign commerce any firearm without obtaining written acknowledgement of receipt from the recipient of the package or other container in which there is a firearm: Provided, That this paragraph shall not apply with respect to the return of a firearm to a passenger who places firearms in the carrier's custody for the duration of the trip.

              Thing is, that I didnt ship the package.. the repair guys did. But I've already called the cops back home.. they are supposed to have a defec... errr... detective call me.

                It's a crime to not report a lost/stolen firearm immediately.

                Edit: It appears that law only applies to licensed dealers.

                  Wonder if that applies to common carriers as well. The licensed dealer in this case is the guys who shipped the thing, and they were also the first to really know that it was gone. (other than UPS) Most of the info I've been getting has been by way of them. They weren't sure it was gone until I checked with my brother to see if it had ever been there.

                    Bet they cut the barrel and she has a mean pistol grip now. Throw on some duct tape you got a street sweeper!

                      This is one of a few semi-autos where you can actually DO that, since the spring system is up front and not in the stock. I wouldnt advise cutting the barrel too much, though. Gotta keep the gas pressure going long enough to make it work.

                          Nothing as yet. I expect that they will contact me tomorrow (i.e. during the regular work week). I've been busy more with setting up receiving the replacement. The head guy at the company I talked to on Friday said to have an FFL contact them to arrange the transfer. They offered me a replacement from their current catalog, which has the "new and improved" version of the missing shotgun. G2 instead of G1. It won't be a Ducks Unlimited edition, which the missing one was (it has the "duck head" stamped into the receiver and a special serial number). If nothing else, it should be easily recognized if it's ever found.

                            Report it stolen, also make sure your brother is on high alert now since who ever stole it may pass information down that there are possible guns at his residence. Can never be to careful now.
