    interfamilial transfer

    Friends brother died and left a common, legal, .308 rifle behind. His only family was his mom, dad, and brother (my friend). My question...

    Is my friend required to transfer it into his name via interfamilial transfer in order to lawfully own it? I assume so, but want to be absolutely sure.

    Interfamilial transfer cannot go from brother to brother. It has to go from brother to father/mom, then father/mom to other brother for strict interfamilial transfer.

    Now if the brother died, I think it would also matter as to what a Will said or who the Executor is of his estate. Is there either?

    If, for example, he has a Will or Executor than whomever is in charge of his posessions would be able to PPT the weapons... I think.

      No will or executor... it looks as if father should IFT then PPT to him.

        No will then requires probate, and property will be distributed according to law.

        I believe it would be helpful to hire a lawyer here.

        If the father receives the gun as a probate-mandated distribution, he would then be able to intrafamilial transfer the gun to his other child(ren).
