California Gov. Gavin Newsom's use of emergency powers to make far-reaching policies during the pandemic was upheld Wednesday by state appellate judges who rejected a lower court finding that the Democrat had done too much unilaterally.

Three judges from the 3rd District Court of Appeal in Sacramento ruled unanimously that the prior judge "erred in interpreting the Emergency Services Act to prohibit the Governor from issuing quasi-legislative orders in an emergency."...

The appeals court said the lower court rulings raised ?matters of great public concern regarding the Governor?s orders in the ongoing COVID-19 pandemic emergency? but agreed with the governor?s contention that he acted within the broad emergency authority granted him under state law in times of crisis.

The appeals court relied on a section of the law that says the governor shall "have complete authority over all agencies of the state government and the right to exercise within the area designated all police power vested in the state by the Constitution and laws of the State of California."...

There are several threads in this section where I detailed how governors have 'granted' themselves rather broad and far-reaching powers in an 'health emergency.' Chief Justice Roberts in particular has been hesitant to allow SCOTUS to become involved in 'public policy.' You might note... Roberts, Kavanaugh, & Barrett Side With Liberals On Maine Vaccine Mandate, which is also from 2021. It's one of the reasons we don't want the Left working 'guns' into a category which fits under the rubric of 'health crisis' as it would allow for invocation of 'emergency powers.'

Problem is "any" is supposed to mean like "since the legislature can't predict WTF they should do in advance", but some how became "Constitution and Bill of Rights is null and void, local health officer is now dictator". Cops went along with this because Lockdowns gave them new powers to screw with normie citizens, then they got Vaxxed. If Vaxx4Cops happened first they wouldn't have gone along with Lockdowns and simply called them "unlawful orders without authority". Cops typically have a natural resistance to anyone trying to get them to do anything.

Sort of like they say "USA is free country, you can do anything you want" when they really mean "anything that doesn't interfere with anyone else's Rights".

Courts will always side with The Powers That Be. If you think path that a case takes as various courts rule, get reversed by higher courts, etc isn't pre-decided you probably think pro-wrestling is real, too. If you think a court rules against The Powers That Be you just don't know who the real powers are. Courts don't rule on laws, they let you know who the real powers are.

I'd imagine attempted enforcement of such would be a breaking point and LEOs would find themselves getting real "push back" from a YUGE % of the otherwise law abiding population, not to mention likely post event "Great Reset" of their position as protected Civil Service unionized entrenched Outer Party members, and sparked a related "Big Re-Think" about GOvt authority in a ginned up "emergency".

Sudden imposition of County Borders could spin into real panic as people rush to try to leave before it becomes enforceable with enough Goons or National Guard.
