    Losing my job

I work for a public agency in Contra Costa and Alameda County (parks). I have been put on payed leave until my skelly hearing next Wednesday February 2nd.
They are mandating everyone get vaccinated or put in for a religious exemption some were Approved others pending, my self and 2 others gave been placed on leave.
If anyone has a recommendation for a lawyer in the bay area let me know.

Last year we moved to Calaveras County, build our home(modular home). We are off the grid. 100% solar with batteries, well. The only thing we require is propane for kitchen range and water heater. Home is mortgage free.
I have applied with the county for employment since a vaccine is not required for employment (Calaveras & Tuolumne).
I have also I have applied to Lowe's just to have a job.
I will be taking over 1/2 pay cut. But I'll least have my pride and that my body is not for sale.

Does anyone here work at Lowe's and could give me some advice on their family Healthcare. I'm going to be applying for floor associate.

    Thank you

Did you put in your exemption letter? If not, atleast put one in in the hopes it gets approved. Many companies/aganecoes who mandated the vaccine are not being hit with lawsuits and are rescinding the mandate.

I did put mine in, they said my beliefs didn't preclude me from the vaccination, I since then filed with the EEOC and the DFEH.

How long have you worked with the county? I am currently using Greg Mullinax in Fresno. He's handling the denial of our religious and medical exemptions for City and County of San Francisco. There are other attorneys I could also refer you to in case Greg isn't taking anymore people.

Supposing that you do end up losing your job, is it a punitive separation? My understanding is since the vaccine was not a requirement for your employment with the county(s), it's considered non-punitive since you simply are not meeting current requirements (i.e. like being permanently disabled, etc). You could transfer your pension to another county you get employment with within California, along with any deferred compensation, etc, that you contributed to while employed with CC/Alameda.

How many of your coworkers wanted these shots and how many took them under duress?

Quite sure all those who took the shot under duress are going to want those who haven't to also get the jab "because I had to!"

Sounds like you're in good shape OP. You have a backup plan in place. If you do get terminated, while things are sorted out, ACA can help with the health care part. I noticed while on UI and later on SS they had some algorithm that discounted much of that income and provided plans at ridiculously low cost. The rest will sort itself out. If you're looking at a by the book solution, expect the legal grind to go slowly, plan for that reality.

If you have practical aptitude, plenty of parallel economy opportunities where you bought your home in the hills. Big names and regular paychecks are nice, sure, but there are other ways to provide. IMO, cover all the bases. Consider it a survival situation in the current climate.

Health is wealth. God be with you.

I've been in public sector labor relations in CA and NV for almost 40 years (17 in labor, the past 21 in management/consulting) - the best labor (employee representative) lawyers in the bay area are with the firm Rains, Luchia, etc

California's premier full-service law firm with an emphasis on the representation of peace officers in disciplinary, criminal, labor, workers' compensation, personal injury and other civil matters.

FWIW, the DFEH won't take your case unless it's a sure-win. The DFEH is pretty much on the side of the Gruesome, so it's pretty much a no-take case. They'll just issue you a "Right to Sue" letter and you take that to find your own attorney.

Not for them to decide this.
This is literally why the church of the flying spaghetti monster exists. They can't say it's ridiculous inconsistent illogic or not long established.

And 'religious' exemption includes strong moral objection.
I have a strong moral objection to forced medical procedures. It's sincerely held. And includes my revulsion of unit 731, and the Nazi experiments on humans.
