    OSHA EO In Concrete

Trump's EOs were thrown out by federal courts all the time. Red state circuit courts afraid to challenge Biden's EO? Other than states' opposing EO I can't find any court action.

Biden's EO is an order to OSHA to create regulations. There's not much to challenge in court until the regulations are published, or any mandate enforcement begins.

Though Arizona just filed the first case, but the angle they are taking seems weak. They filed an equal protection case regarding how illegals are being released without vax required, but Americans are required to vax. I think this specific case fails because if/when the released illegals get a job covered by the vax mandates, they will face the same vax requirements.

Though we don't actually need to win the case, all we need is a temporary injunction while the case is litigated. Maybe throwing enough at the wall in the hopes something sticks is the right strategy. By the time the case is litigated, we'll know a lot more about vaccine risks.

I read online somewhere that OSHA is actually extremely undermanned, stretched very thin just trying to enforce the extremely complex and vast multitude of regulations they already have.

Can you imagine how many boots-on-the-ground employees it would take them to go to each and every business in America, that has more than 100 employees, to confirm with their own eyes that they are following the EO?

I'm not a lawyer or an OSHA expert but I feel that they are just going to work with the honor system or maybe have people snitch out businesses.

Has to be a violation of personal liberty. It's not the same as requiring safety gear. Even our state doesn't require it for state employees
It's like saying you must shower twice daily and send a time stamped video proving it

        OSHA can't have unchallengeable power.

Was just about to post a similar question/thread.

When Trump was president and he would make an executive order, within a couple days some leftists judge would block it no matter how legal the executive action was.

I'm confident that this illegal action by the Biden administration will be blocked, not doing so would have a catastrophic outcome. My worry with all this is how long before it gets blocked, at the very least until it gets to court. There is a specific term for this.

It would be bad if thousands of people lost their jobs because of corporations following this edict, only for the edict to be deemed unconstitutional a few weeks/months later.

My wife is worried about her company going through with this, but in my opinion her company needs to worry about doing it. She is one of only two people doing payroll for a company with over 1,000 people in multiple states. She didn't want the stress of being the payroll manager, so she's only the "specialist", but she is the one who corrects errors that her boss makes.

They have tried to hire several people after having to fire an employee that routinely screwed up the payroll for the companies that she managed (typically fixed by my wife), but they have had serious issues trying to find anyone up to speed enough to deal with the horrible software they use and the complications of different state regulations, etc.

She WILL quit before submitting, so there will then be NO ONE who knows WTF they are doing. That should work out nicely, and she likely will quickly find another job at a smaller company that won't require the vax.
