correct as to the masking part - "or be subject to regular testing and mitigation requirements." there's never been any law for a mandate with no exceptions, but this type of mandate will be legally enforceable

In essence, because the current Administration is providing 'back up' via DOJ as to their opinion that it is legal. The only appreciable delay(s) is/are due to the politics involved; i.e., do Democrats want to be the Party of overtly taking choice away from individuals and mandating that your body isn't your own going into 2022?

Bear in mind that you first must have an actual mandate to challenge. Then, court challenges can take time to 'properly' put together; particularly if there are accommodations, exceptions, exemptions, etc. in the mandate. Just think about all the gun cases we discuss.
