    Its my understanding that HIPAA only applies to medical records maintained by health care providers, health plans, and health clearing-houses. Any health-related information which exists outside of health care facilities and the files of health plans is not covered by HIPAA.

      Makes sense but can I be required by an employer to provide or create medical records?

            I think you could make a case that it does and it should. We are in the middle of a new paradigm and it's one of the first times in history that an employer could show valid reason to question your health other than requiring a TB test for school and such. If they are going to gather health records those records need to be protected by law.

              I do contract work for a healthcare facility and pretty much everything is a medical record. Video of someone getting out of the elevator is a HIPAA protected medical record.
