    Magpul AFG on Benelli M4

I'm getting a Benelli M4 as a trade and had a quick question. It has the Surefire M80 rail system on it and was wondering if I can add a Magpul AFG to it, or will that make it an Assault Weapon? Or is it in the grey area? Can you even have a forward grip on a semi-auto shotgun?

    Thanks.

As long as you don't also have a collapsible stock on it you are fine even with a regular pistol grip.

Okay, that flowchart is kind of confusing. I thought it says even if it doesn't have a collapsible stock it makes it an Assault Weapon by adding a forward grip.

I think the chart says vertical grip, DOJ does not consider the AFG as a vertical grip.

I thought this was not 100% confirmed.

This! On 13, if you answered no, then it follows a different flow on the flow chart. You can't have a collapsible stock with a vertical grip in the forend, but if it's collapsible, then no vertical grip at all.

                    12276.1 (a)
                    Notwithstanding PC section 12276, assault
                    weapon shall also
                    mean the following:
                    (6)A semiautomatic shotgun
that has both of the following:
                    (A) A folding or telescoping stock.
                    (B) A pistol grip that protrudes conspicuously beneath the ac
                    tion of the weapon, thumbhole
                    stock, or vertical handgrip.
VFG (VHG) = anything forward of the trigger which allows for a pistol style grasp. The AFG doesn't meet that requirement, but that will not stop an arrest or charges to be filed against you. It would be up to a jury to decide without a document issued by the CA DoJ specifically saying the AFG isnt a VFG. Without that its up to a DA if they want to press charges and they would since the ruling would provide guidance to the other DAs. This is of course at your expense if you don't meet the courts threshold to be provided legal aid.

I wouldn't do it on a semi-auto. I am going to do it on my 500A

PS- Most people with a job do not qualify for a Public Defender at the Courts expense.

The key word is "both".... So as long as it doesn't have a telescoping stock it should be ok.

This is one of those sticky areas and I haven't seen a case on it yet.
