    This is a realy interesting thread,

    Im sure we have all experienced or know some one who has had there car busted into, when i lived in Oakland, yer dont laugh, well i had my Bronco busted into. the next morning i awoke to find my old bike which i stupidly stored in the back of my bronco had been taken from it along with CDs , what amazed me, is the fact that although the bastards ripped open both the small windows that edge up to the pillars and ulitmatley broke the glass out, they were like surgeons when it came to extracting my bike from behind the back seat as i found no evidence of ripping the interior seats or liner, for that i was impressed. at the time of living there i didnt have a gun.

    what was worse, was the time i saw this black shadow of a man walking fast away from my old cougar i ran down from the apartment building to find the door mirror hanging by its wire and all my mercury badges ripped of or just broken in the attempt to get them,, by the time i got down the guy was pulling away in his car, i had thought of chasing him , but for what, to get a bullet in my head or a knife to the throat, i dont think it would of been worth it for all that he did not get.

    Though looking back if i had of come across these individuals at the time of them braking in to my cars, and i was armed, shooting them even if it was just in the knee cap just so they could not get away, would i believe put me in jail.

    If a struggle with one or any off them would of happened, the likely hood is they would be shot, as i would not want them to try and take the weapon from me, would this then make it legal shooting them in the defence of them tackleing me and possibly trying to grab my weapon to use on me. or would i end up being arrested on man slaughter charges.

    I have read that the law is different if they are in your house and it become life threatening but how does it work when there say in your back garden or drive way, or private parking space. or sitting in your car.

    Personnely i would prefer to be able to shoot on sight if i see them braking in to what does not belong to them, because there is a great risk involved when you stumble across a crime been commited, they could attack you as a fright defence mechanisem, or they could have it preplanned in there heads that anyone crosses them they will get shot or knifed. So i would want to pre-empt there plans.

    I think in the situation were you have on guy running away from the car and the over one taking a head dive , i would of drove the butt stock into his groin area to disable him long enough to call the cops and then hopefully he would give up his buddy.

      You can carry to make a citizen's arrest.

      Back to the original post: Too bad you didn't manage to/decided not to make a citizen's arrest in this case. But that sounds like it was your intent.

        Wow I hope those guys dont come back for the gun nextime...especialy when they dont see any cars outside your home and thinking no one is home and your at work

          Wouldn't have done any good. The charges they would have charged on them, if any at all, would either be tossed or plead out to something really cheap. In other words our justice systems wouldn't do anything with them. I think putting the fear into them did much more.

            I kinda know how they felt

            In my youth, there was some farm land that had two ponds for farming catfish. We all knew the owner was a little crazy ie. drunk all the time, drove like mad in his truck on the county roads, loner, etc.,

            However, the catfish in those ponds were enormous(for farm raised anyway, 5-20lbs) and would come bubbling to the top when anything was thrown in the water. Fishing was, well, not exactly sporting but hugely fun. Except for having to watch out for the old man when he was coming back.

            Knowing that, "friends" were out squirrel hunting and decided to sneak up behind us and let off a few rounds yelling "Get off my land". In true country boy fashion, I didn't let go of my rod 'n reel (Daiwa Magforce baitcasting) but just took off not looking back even when the hook coming out of the water got wrapped around a tree, 20lb test didn't stand a chance and I certainly didn't slow down. (Just as a side comment, cats have more sense than dogs. When cats run, they don't look back. Most dogs, will sneak a peek if they can.) Also, I was fifty yards down through the trees before I even knew where I was at much less tracking where my fishing partner was!

            Never went back unless I could account for all the so-called "friends" location.

            Funny how some memories are in HD and others are like the old PBS channels on UHF. Funny now, not so much at the time.

            I can guarantee this. This will be one of those HD memories for them.

              EXACTLY! That was my point. Honestly, I really think these youngsters WONT be back. If they do, then we'll deal with that if it happens. Oh well, thats what kinda society we live in. Sucks!

                      In my situation the people who broke into my house actually not only tried to file a police report(failed since the cops were on our side) but made false claims and tried to get a TRO(instant disarment and would have cost my family 10's of thousands of dollars) for my family scaring off the intruter with a firearm since the guy claimed he was going to kill everyone. Tried to claim the guy just tried to talk to us by walking into our house, that we bashed in our own door in and threaten to kill them. They are our former nieghbors, the family involved with the attack is gone, the owner who was involved in the illegal activities still is there, and the other renter is dead. I guess karma has a wierd way of working. Thats what happens when you help the cops bring down a bunch a house doing a lot of illegal things with lots of money involved. Makes it worse when the newspaper says we helped with the arrest. We figured since we helped the cops they would help us and now i see why our lawyer though we were stupid. DA dropped charges against the intruter because they did not feel conforable pressing charges since we used a gun in self defense. Tried to claim our gun was illegal and we could be sitting in jail. We said the gun is legal and using a 11 year old as an informent is not only illegal but it will not look good if the paper gets ahold of the story with your name mentioned. He took back what he said claimed he is overworked and he would hand it too a "special task force". In the end the cops said we can't help you and if they come back one of the detectives said "pump him full of lead".

                      Sorry for ranting, i tend to do that but just understand the cops will not help, the criminals will use the system to get you punished and as i learned in boy scouts be prepared. Have your gun ready and have a attorney ready, in CA you more 10 times likely to use a lawyer than a doctor.

                            The bad part is, they are still out there and are going to do it agian. Better to get something charged for any future stuff they try to pull.
