    Free shotgun!

    Welp….i bought a new Franchi Instinct SL in 2016. After many years of shooting the crap outa it…the top barrel firing pin went for a hike…nowhere to be found. I called Benelli who owns Franchi and got a repair ticket and sent it in. They just informed me that they are giving me a new gun. Evidentially the receiver was cracked. The guy said “that ain’t supposed to happen”…so they are replacing the gun. Gotta now do the whole FFL thing for the new gun.

    I have a question though. Do I need to do anything to report the old gun is being kept by Benelli? Does the state DOJ or some other tracking agency need to be notified? Thanks.

    No, there is no reason, as the gun and it's serial Number will be destroyed by Benelli, so it could never come back on you..

      I’d ask Benelli to strip down the gun and send you any usable parts. Selling that barrel should easily cover your dros fees. The wood on those guns also hold some value.

        I have to call them Monday…hadn’t thought to ask to get it, or parts of it, back. Would make a nice display momento…Lota shells down those barrels. Thanks for the comments.

            Post 1, when I had firearms replaced (by Glock and S&W), I received/obtained letters from the companies; I think I filled out a California form; and sent/transmitted the form and copy of letter to California DoJ, as I recall. Apparently, the destroyed firearms' serial numbers were removed from my name as whatever firearms are still registered to me. However, there should be no penalty to you if you never do this as far as I know.

              I need to get a letter stating that it is a warranty and not a purchase too. The damn state 10% tax and the 11% gun tax would be due otherwise. The FFL fees are bad enough…plus my damn FSC is expired too. Thanks for the comments…I will follow up on Monday with Benelli.

                The state does NOT keep a current accounting of what you have "in your name".
                They only keep a list of what you have DROSed.
                Even if you submit a "no longer in possession" form, those guns will still show as having been DROSed to you if you request an AFS report which is the full list of what you have previously DROSed.

                DOJ can search a specific firearm to find out who ALL the previous DROS records for that firearm are and the guy that you PPTed it to will be at the end of the list showing him as the current owner if he has not already PPTed it to someone else, but you will still show up as a previous owner in the records.

                  according to Benelli, they will destroy the gun and do “paperwork” showing that. I asked what will they do in THIS state to show the old gun as in their possession or destroyed. They said they will take care of it. I failed to ask anything else. Should I be doing anything in this state other that processing the new gun to me?
