    Benelli m1 tactical?

    I have a Benelli m1 tactical, pistol grip, and 7+1. It is semi-auto, and kicks ##s. Is it legal in CA? What do I need to do to make it legal? When my uncle gave it to me I could not say no!

    As long as it does not have a folding stock, it's CA legal.

    Per CA laws, for the transfer to be legal, the firearm needs to be transfered through a CA FFL dealer.
    If he just handed it to you as a way of transfering ownership, then you both committed a crime.
    If you are both CA residents, then it's a misdemeanor for both of you.
    If he is a non-resident of CA and you are a resident of CA, then it's a Federal felony for both of you.

      Thanks, I have been told many different things over the years. Semi-auto's with pistol grip are illegal, unless 5+1. All the different combinations I was told were crazy.

            You'll hear a lot of information out there from many different people. Some of it will be accurate, majority probably won't be. It helps to do your own research and you came to the right place.

              That's from Federal laws.

              Gun Control Act of 1968 created the "sporting purpose" requirement for importation into the USA for civilian sale.
              Fed 922r = imported shotguns with a pistol grip and a capacity greater than 5 rounds does not meet the "sporting purpose" requirement for import/sale to civilians.

              H&K marked Benelli shotguns were imported prior to Fed 922r going into effect and are "grandfathered" in (they were imported with pistol grips/folding stocks & capacity greater than 8 rounds), therefore they do not have to comply with Fed 922r.

              All Benelli shotguns imported after 1994 must comply with Fed 922r. So, under Federal laws, in order to legally have a pistol grip and a capacity of greater than 5+1, the shotgun must have fewer than 10 foreign made parts (foreign made parts, need to be changed out with US made parts).
