    Issues with FFL

    I recently met up with a fellow calgunner to purchase and transfer a saiga 12. We both agreed to meet at Guns, Fishing, and Other Stuff in Vacaville. We entered the facility and the guy at the counter checked the SG to make sure it wasn't loaded and sent us upstairs. We proceeded upstairs and started the DROS, the young guy behind the counter was quick and the transaction went quickly.

    We both leave the place thinking that was one of the easiest DROSes ever! I get a call 4 minutes later and am told to return to the place immediately. Luckily, I stopped for gas. On arrival, a lady behind the counter informs me that the seller needs to be contacted so the he can remove the SG from the building. She then informs me that the firearm is illegal. I then call the seller to comeback, which he then proceeds to do. I ask the lady why she considers the firearm illegal, it has a 19"bbl and 41in OAL, with a properly installed maglock. She then states she doesn't know and that the owner of the store said so. I then ask for my DROS fee to be refunded and she states that she won't do it because they started it and if I want it back we can call the Sheriff's office.

    The seller returns and tries to explain the legality of the SG, but the owner named Travis was staunch in his belief that the firearm was illegal and didn't want to hear our explanation. He then called the saiga 12 a , "street sweeper". Not wanting to deal with them anymore, we yelped the closet store that would complete a DROS. I at that point didn't care about the refund, but wanted to complete the transfer because I was coming from Daly City, an hour and half drive away.

    We then drove to Center Mass, 5-10 min away. We informed them about the entire ordeal and they were irate that an FFL would not only cancel the DROS, but would not refund us either. They then proceeded to call DOJ to make sure they could complete the transfer because it had been cancelled earlier. They told me I should go back to get a refund and a copy of the DROS. I knew this place would be fine with all the Calguns posters and flyers they had.

    I went back the Guns, Fishing, and Other Stuff and asked for a copy of the cancelled DROS and informed the owner that I had contacted the DOJ and they said the firearm was compliant to state law. He then just waved his arms and said it wasn't before.

    I am on the freeway home and guess who calls, one of the workers from Guns, Fishing, and Other Stuff to inform me that they had made a mistake and would be willing to refund me.

    From this experience I know that I should've called beforehand to confirm that they would complete the DROS and am a lot more informed of my rights as to dealing with an FFL. I am just annoyed at the fact that they probably wouldn't have refunded me, had I not informed them that the DOJ was informed of their actions and that as an FFL you would know more about the business your in. A simple call to the DOJ from their point would've resolved the issue easily.

    Sorry for my long rant.

      If everything you say is true and you are not leaving anything out, I would say that the store owes you a refund, an apology and a heafty bonus of some kind to compinsate you for your extra time and expenses. But, that would just be good customer service and good PR. Hopefully, the owner will come here are post his side of the story and, if what you say is true, issue you a public apology. If his story differs, it'll get interesting. In any event, as someone who ocassionally stops at gun stores from Chico to San Diego, I'll avoid spending a dime there until I hear both sides and figure out how much of each side to believe.

          I would appreciate to hear the shop's version of the story. I did go back to the shop to get my refund when I picked up the saiga from centermass. The owner was not around, but they issued the refund without any conflict. As for the apology, I doubt I would get a sincere one. At this point a sincere apology and/or compensation are not needed.

            DANG moose..!....first of all...Welcome to Cal Guns.! A nice bunch of folks here.!

            Too bad the owner of that store is a DRAMA QUEEN. A Know-it-all.

              i tried to do a private party transfer there a few months back , waited almost an hour only to be told by a woman working there they didnt have the time unless i was buying a gun from them. used my smart phone, found center mass and did the transaction there.

              i wound up doing another transaction at center mass a few weeks later. pretty nice group of people working there.

                  If an FFL runs a DROS on an "illegal gun", then they are responsible for the DROS fees when they cancel. If the FFL doesn't want to be responsible, then they shouldn't have accepted the firearm and started DROS.

                  Then the proper way to do it is to state to the customer, "I am really sorry, I shouldn't have acceptted this firearm as I believe it is illegal for me to possess. I will refund you in full."

                  If a dealer honestly doesn't think a gun is legal, then they have the right to not go through with the transaction. How anyone wouldn't realize a Saiga 12 gauge with a fixed magazine device is not an assault weapon is beyond me, but hey, I actually pay attention.

                    SAIGA 12s were banned in CA....still are...EAA

                    LEGAL CA SAIGA 12s...proper configuration...correct Importers are good to go...

                    Not every FFL hangs out on CALGUNs....so I always tell guys to check with the FFL to see if they will except the xfer or PPT...this won't always insure a hassle free trip but it helps...

                    They shoulda given you a refund though...and eventually they did...

                    It is a two way street and you gotta educate people...

                      The owner I met there was called Bill, an older gentleman they just went through an ATF audit and at the same time I asked to buy a C&R rifle with my 03 FFL license. He checked with the atf and I was told I would have to Dros the C&R rifle wait 10 days etc... That part I had heard before regarding 01 cannot sell to 03 without DROS I just wanted to verify it. Another thing they do is require is a 2nd form of residence ID "utility bill, car registration" for LONG guns.

                      2-3 years ago I bought a used 1858 Remington cap and ball they wanted to do a DROS on that. Reason I was given because the cylinder could be replaced with one that shot center-fire cartridges. I argued the point told them it was a black powder gun and did not require DROS or paper . They finally sold it to me as black powder accessories. It a great store, many C&R guns but a pain to buy from.

                        how do you figure that EAA Saiga-12 are banned in CA? I see no listings for those in the ban list.

                        there are no Saiga Shotguns, from any importer, that are listed in 12276(c) or in the 12276(e) secondary list.




                        Yes, I know that S-12s with a detachable magazine are banned under 12276.1
