    Benelli Supernova Legality

I have the supernova with the tactical pistol grip and want to add an extended magazine tube to increase capacity from five to seven or eight. Being imported from Italy and having a pistol grip, will I be violating any state or federal laws? It is pump not semiauto, if it matters. Thanks.

I have several mods done to my super nova and my local Class 3 FFL dealer says i'm legal. But I know some people hear say no. So its your call. You could always contact a gun law attorney.

My understanding is that 922r impacts all imported shotguns regardless of action.

      Section 922 Paragraph R states:
"It shall be unlawful for any person to assemble from imported parts any semiautomatic rifle or any shotgun which is identical to any rifle or shotgun prohibited from importation under section 925(d)(3) of this chapter as not being particularly suitable for or readily adaptable to sporting purposes except that this subsection shall not apply to--
      (1) the assembly of any such rifle or shotgun for sale or distribution by a licensed manufacturer to the United States or any department or agency thereof or to any State or any department, agency, or political subdivision thereof; or
      (2) the assembly of any such rifle or shotgun for the purposes of testing or experimentation authorized by the Attorney General. "

I've done extensive research on this and still no true definite answer. I've read all the federal laws on this and there seems to be a conflict. I've seen this 922r section also and read contradictory statements towards it in relation to certain types of shotguns. Even read in a shotgun forum about an ATF agent actually saying "it's legal to add extended mag tubes on these Benellis". I don't know, I guess no one really knows the answer since there has never been a case about it to go back to.

Ya that’s how the law works LOL. Every time I have talked to the DOJ and the ATF they cite conflicting laws about legality, and when I ask for clarification they tell me that can not and will not offer legal advice, and that “it would be up to the citing or arresting officer to determan legality. I think it’s all a bunch of BS they don’t know WTF the laws are but they can choose to hang someone for their interpolation of the law.
