Shotgun for car defense.

I know shotguns can be transported with out being locked up or in the trunk but they must be unloaded. If one wants to carry a double barrel shotgun with both chambers empty and a buttstock shell holder installed and loaded with shells is this ca legal. Would the shotgun still be considered unloaded in the eyes of the law.

Yeah, that's legal per state law. Feds have some weirdness surrounding school zones and unlocked guns, but to my knowledge it has never been applied since being found unconstitutional and revised.

Also, my car defense weapon is my car. I can run someone over or drive away a lot faster than I can load a shotgun.

Having shotgun shells on the stock is the same as a side saddle and is perfectly legal. Assuming like said above you not commuting through school zones and have to worry about that lock.

Saiga-12 is an ideal vehicle deployed shotgun. You're able to have loaded magazines and can just lock them in, and you're ready to rock.
It'll be much faster than topping off a tube.

I thought it would be legal. I would lean towards the double barrel for its size, simplicity, and reliability. The Saiga maybe faster/easier to load but it is much larger and I would prefer something that looks more sporting and less "evil". Or maybe I could get a Saiga and paint it with rainbows, butterflys and peace symbols. How are those Saigas anyways.

I keep a bolt action 20 guage in my car. It is magazine fed, and just in case I need it. Its ready.

Concur on empty chambers and ammo on stock = legal. People v. Clark is the controlling case law.

don't know of any shotgun, that is a good defense, against a fast moving car!

I am not a troll or am I trying to start shut but why would you want to carry a shotgun in your car?
If you have some road rage problem and the other guy gets outta his car you gonna shoot him? It seems like a bad idea to me. I do agree with the others if that big of a problem came up just drive away. But hey what do i know.

Different people different need and requirements. If he feels that he needs a SG n his car... So be it. It doesn't bother me none. As long as he's not waving it around I'm cool with it.

But for you example, some guy did get shot and killed from road rage. He came out of the car with a baseball bat and hit the car behind him, tried to assault the driver but the driver took out a gun, shot and killed the guy.

I'm sure at times like that you would wish you have a gun in your car.

Btw: he wasn't charge for murder. happen n sac 10 years ago or so......dang I moved away for that long?!? ... Lol

personally, i wouldn't keep a SG or any gun in the car. just another item to get stolen and/or used against you.

I've never been a fan of "trunk" guns. Yes you could go to it, but it could also be stolen when your in the store. If my gun isn't on me, then it won't do any good when I need it anyways.

Like others have said though, you can have shells on the buttstock or a side saddle and be legal. Although you may still get the cop who is having a bad day and doesn't fully understand case law.

I agree, although without a CCW, that is pretty much all we're left with. Either that, or the intensely LEO attracting option of UOC, which can get pretty nasty at times practicing that here in "Fortress Kalifornia."

But seriously, for the few times you would or could actually need it, the bigger liability is, as mentioned, is theft of your firearm or your entire vehicle with the gun locked inside.
Because you are thinking about it you must have some concern, so yes it is legal, but is it wise or your best choice....only you can answer that one.
Of course you're reading thoughts from a guy that carries a Kel-Tec SU-16 and 100 rounds of ammo in magazines when he travels by truck too. It's folded in a lawn chair bag, I carry it in most places I go along with my daypack. Looks very innocent.
