Are there capacity restrictions for tube type of magazines in a semi-auto shotgun? A friend of mine is thinking of buying one of these and told me he can't get the 7 + 1 in California. He said only the 4 + 1 is legal? I thought this was FUD, but I don't remember all the rules around semi auto, pistol grip, shotguns, other than no collapsable stocks. Thanks for any input. c good

Like the other one said 922R was signed by Bush senior and places some restrictions on imported semi auto rifles and semi auto shotguns. About 9 months ago I literally spent hours looking into this. Bottom line is that is a limit to the number of foreign parts u can have on the Benelli. If you just put on a USA mag tube to the Benelli you will be in violation of federal law. You will find much contradiction on how many parts need to be swapped out and USA made. If you really want to comply with the law the only way I would feel comfortable with this would be to get a letter from the ATF for the specific made in USA parts you want to add and then ask then to tell you how many foreign parts are on it. Others will tell you how many you need to swap out. Again, after spending hours googling this, I have seen scanned letters from ATF that are contradictory.
If you want to avoid these issues you can get the Mossberg 930 SPX and have the 7+1 good to go and not have these legal issues. There are other semiauto SGs as well.
From my extensive looking at the law, I decided the Benelli was worth the headace based on the Federal law.RIP Louis Awerbuck. I miss you and your training.Comment

There is nothing that I know of in CA law that says you can't have an extension tube on any shotgun. It only bans revolving cylinders and detachable magazines.
As for 922R, it bans the import of foreign made non sporting rifles (Any shotgun with a capacity greater than 5 rounds)... That is why Benelli castrate the M4 when importing to the US.

Apparently, the Benelli has 13 of the 20 "compliance parts" that the ATF cares about. Replacing the whole tube with a US made one itself counts toward making your Benelli M4 compliant under the law. So you need only replace two other parts of the 13 foreign made ones listed to make your M4 legal under federal law.
The handguards and follower are popular replacement parts to make Bennelli M4's 922R compliant.

Only thing CA restricts would be in regards to the large capacity magazine ban [PC 12020(a)(2)].
If you increase the magazine tube to greater than 10 rounds, then you have manufactured a large capacity magazine which is illegal.
Abide by the 922r parts compliance issue and it's legal to increase the capacity of a Benelli M4 to 10 rounds or less.
Penal Code 12020
(a) Any person in this state who does any of the following is punishable by imprisonment in a county jail not exceeding one year or in the state prison:
(2) Commencing January 1, 2000, manufactures or causes to be manufactured, imports into the state, keeps for sale, or offers or exposes for sale, or who gives, or lends, any large-capacity magazine.sigpic
