Benelli M1014 Limited Edition question

I am being laid off and am selling off some of my guns. I had just posted up my shotgun when I started getting PMs saying I have an assault weapon. From what I have read, my shotgun is not. The stock does not collapse on my shotgun. I did buy the rod that would allow it to do so, but it has never been installed. I have the +2 magazine extension, but that is not installed either. With that being said, the barrel is 18.5 inches long, has a pistol grip, and the stock doesn't collapse. Does this still make it an assault weapon? I am moving to Nevada so, if I cannot sell it here, I will take it with me.

Please give me some input.

(a) Notwithstanding Section 12276, "assault weapon" shall
also mean any of the following:
--snip--
(6) A semiautomatic shotgun that has both of the following:
(A) A folding or telescoping stock.
(B) A pistol grip that protrudes conspicuously beneath the action
of the weapon, thumbhole stock, or vertical handgrip.
(7) A semiautomatic shotgun that has the ability to accept a
detachable magazine.
(8) Any shotgun with a revolving cylinder.

I read that too and based upon what I read and what my particular shotgun has it is not an assault weapon. Am I reading this correctly? I just don't know anymore.

Yes, you are reading it correctly.

Your Benelli M1014 Limited Edition is not an assault weapon in it's current form.

If you were to install the rod that allows your fixed stock to collapse, then it would be an assault weapon.

so as long as i have NOT installed either the +2 magazine extension or the 3 position rod, its ok? makes me wonder how i ever was able to buy this way back when i did.

Yes. Not installed = legal.

Also be advised, that if you did install the 3 position rod and +2 magazine extension (in a state that is legal to do so, like NV), you will have to comply with the Federal 922r parts requirement.
