Is this a "legal shotgun ???

I like nice stuff even if its only a single shot gun. This is going to be my "club gun" and I'll probably use my 12ga for my real hunting until I can afford my over/under. I'm planning on more puppies to train down the road so I'd like a gun that looks, feels, and shoots well and I like this Beretta. The PARDNER just doesn't cut it for me anymore.

So if you could check this thing out, it's not like the regular breakdown shotgun I'm used to seeing and I'm not sure what Johnny Law is going to think. Barrel is 26" or so they say ????

    Thanks !!!

I've got one and love it. It's perfectly legal and I don't even understand why you thought it might not be.

Should be 100% legal, unless I'm missing something here. With each pull of the trigger, you must manually break the action open and re-insert a new shell each time, right?

As long as the shotgun is not semi-automatic, it doesn't hold more than 10 rounds and you don't have a grenade launcher strapped to it, the sky is pretty much the limit. Minimum barrel length is 18" and OAL is 26".

On the top right of the screen you'll see a link that says "CA Shotgun AW ID flowchart." Should be a helpful tool for any time you're worried about the legality of a shotgun.

I found them on an auction site and they posted a warning about Cal firearm issues. I think the law states no less than 26" total length for a shot gun collapsed or folded ???? Just checking before I purchased the fanciest single shot around (other than a full blown skeet gun)

The OAL is the issue, the thing folds in half almost but doesn't break down into two pieces so its technically not "broken down" thats how I look at it. And I've had DFG people talk to me about carrying firearms broken down though an area. {--- might have issues there but I'm mainly thinking DOJ DROS stuff right now.
Thanks for the input so far

If someone gives you problem over a single-shot, 26" barrel shotgun tell them they have bigger fish to fry!

              That thing is perfectly fine..

Obviously a large bore, close range sniper assault weapon - it's not illegal yet but we should illegalize them before gang bangers realize the deadly potential of single shot break action shotguns.

I think it has to be able to fire in its colapsed configuration to be illegal, that is why the Keltec Su16 is legal. Might just be rifles though...

Hey, my apologies. I thought you might have missed it since it's somewhat new to the site.

As for OAL, that rule generally only applies to the weapon in a firing configuration. OAL is measured of the firearm in its shortest firing configuration. So I do not believe you have to worry about a break action shotgun's OAL while it's open. You measure its OAL with the action closed. And just for comfort's sake, even if we did measure this firearm with the action open, the barrel alone is 26 inches which meets legal requirements itself.

There should be no problem with this shotgun.

what confused you, that it could be measure while broke open and get a <26" measurement? I designed the chart, with obeygiant's help, so any help in clearing up points of confusion would be helpfull.

The pertinant Case law was regarding a rifle being considered an SBR. I don't recall a shotgun being mentioned in the case. However, it would not be a smart idea to ignore it with a short shotgun claiming the method of measurement, with the firearm in its shortest fireable configuration, only applies to rifles.

I'll see if we can update the chart to clarify that OAL is measured in its shortest fireaable configuration.
