    He can legally borrow it up to 30 days.


    Penal Code 12078
    (d)(1) Subdivision (d) of Section 12072 shall not apply to the infrequent loan of firearms between persons who are personally known to each other for any lawful purpose, if the loan does not exceed 30 days in duration and, when the firearm is a handgun, commencing January 1, 2003, the individual being loaned the handgun has a valid handgun safety certificate.

      This sounds like a bad idea to me. Since this is for HD can I assume he is going to keep it loaded? Not much use for HD if not... And since he is borrowing it I have to assume you aren't loaning him a gun safe right?

      So the idea is you are going to loan your shotgun to someone knowing they are going to keep it loaded, not locked up, and around kids, right?

        Tell him to look at a mossberg 500 or Remington 870 tactical at big 5 he can get them for like $350. Just put it on layaway and thats $50 down and $25 a week for 3 months.

          I say buy him a shotgun for Xmas, bday, or to just be a great brother. Cheap Mossberg or Remington.

            You can get an inexpensive gun locker with a key lock that will keep the kids out too.......

              Though Mossberg 500s may be inexpensive, they are very reliable and I would trust my life with it. Also may be able to find a used Moss 500 for even less. I like the idea of a Christmas gift. I don't like the idea of loaning it out. If something happens, you could end up as part of a lawsuit since you own it.

                And dont forget to make dam skippy he knows how to operate it properly...along with proper trigger/muzzle control, etc. You can find a used C&R double shotty on Gunbroker for 125 on up BTW...

                If your going to loan it to him and he uses it, you will get sued in any lawsuit along with him. If you do loan it to him, he can only have it for 29 days at a time...so every 30 days, it gets to come home and visit for an overnight sleep over!

                  So how would anyone know it has been on loan over 30 days anyway? Another dumb law. Do a PPT to get it into his name and out of yours. If you want it back someday,do another PPT (you can pay for it) and you are covered. Or do as has been already mentioned, buy him a gun or PPT and give him yours. Then you would be justified to buy yourself a nice replacement
