922r and Benelli M4

Been a while since I've purchased a firearm where I had to worry about 922r compliance regarding parts upgrades. I've been eyeballing the Benelli M4. I'm going to want to replace the 5 round mag tube with a 7 rounder. If I'm understanding the law correctly, as long as the gun has a non-collapsable stock, I only need to replace 3 parts with domestically produced parts, correct? So replacing the mag tube, mag spring, and cap or follower with U.S.A. made parts should keep me compliant, correct?

Section 922r of US Code, Title 18 is a regulation which pertains to building or modifying a semiautomatic rifle or shotgun from imported parts. This law impacts importers, manufacturers, gunsmiths and consumers who assemble their own firearms.

I assume your M-4 came from the manufacturer?.yes, just use US made aftermarket parts for upgrades.

That was my understanding when I was reading the law, but it's so convoluted how they have it written that I was second guessing my understanding.

I haven't purchased it yet, but soon. I purchased a Beretta 1301 tactical last year, but still want an M4. It's always been a bit of a grail gun for me. I wish they would do like Beretta does with the 1301 and just add the full length mag tube when the guns arrive here in the US. Since Beretta owns Benelli you'd think it would be a no-brainer for them.

Oceanbob is correct in all respects. 922(r) was beaten to death around 10 years ago on the FAL Files. I'm not aware of any individuals charged with a 922(r) issue.

If you want to go down the 922r road here is your list. It’s not just 3 parts, it needs to from the list specified below.

Most people replace the follower and mag tube, along with a third part (hammer, for example). I went CarrierComp for the magazine tube/follower and an A&S Aluminum trigger guard.

If you haven’t had a chance, Google: 922r Benelli forum if you want to read a bunch of threads raging from it’s nothing to worry about to the second you step out of your house, black helicopters will descend upon you.

I like piece of mind and because I wanted to run the factory field stock, the parts I used I was going to swap anyway.

My comments for whatever they're worth...

Freedom Fighter Tactical and Carrier Comp both have white papers on their sites that explain 922R...at least they used to. It's worth the time to give them a read.

Carrier Comp also makes the best titanium mag tube extension. There are other good ones out there but CC quality is excellent. It's a very "mom and pop" shop though so you may have to wait for it.

The issue of whether 922R applies to individuals or not -

I have ZERO interest WHATSOEVER getting into this debate. Some people believe it is not relevant to individuals. The ATF, however, has issued letters to individuals explaining what changes they would need to make and the relevant/applicable parts to remain 922r compliant. So to me, it certainly appears that the ATF believes it applies to individuals.

My advice is to read the white papers. Do your research. You can write to the ATF and ask them your questions and see if they respond (and if they do, please post it). And you can talk to a qualified attorney, if you wish. And then make up your own mind.

With that said, I don't believe too many individuals have been charged under 922r. I seem to recall their being one dude...like five years ago...who got charged but it was a "tack-on" charge in addition to a number of other violations. I don't recall the outcome. Suffice it to say, it's pretty darn rare. So if you're comfortable betting the odds, you'll likely be just fine.

If you decide to try and comply, do make sure you're clear on the relevant parts. Not every part qualifies as a changeable part for 922r purposes. If memory serves, there are 13 changeable parts if you're dealing with a fixed stock m4. The tube and the follower qualify. The mag spring does not so you'll need to find one of the other approved parts.

Hand guards are on the approved list. The hammer is too. Freedom Fighter used to make both of these, but both of them had problems...quality issues...at least initially. They may have gotten the bugs worked out at this point but I don't know. However, Freedom Fighter would be my last choice for replacement parts. That's just a personal opinion as I had one of their early handguards and it was junk. There was no problems returning it, however. There are probably a few more options now than there were..."back in the day." So some googling will probably yield some good results. Also, the forums over on Benelli's website used to be the best source for all things m4. You might take a look over there and see if the place is still active.

This is what I did. Paid through the nose for a Surefire picatinny handguard 10+ years ago. There are other options now.

Just find a dealer who will sell you an le model. Youll get the collapsing stock and 7+1 without replacing anything. There are many places that sell them.

I was looking into this, but in CA, having the collapsable stock would make this an AW, no?

I just realized Benelli sells a 922r compliant model with the 7 round mag tube, and pistol grip, non-collapsable stock. It's model 11713. Think I'm going to hit up my dealer to order me that one and be done. I probably should've checked their website to begin with lol.

Good call. I swapped my hammer out years ago but that was back when Geiselle was still making their unit. It sucks that they discontinued it.

FYI, note that Midwest Industries started making some Benelli m4 parts a little while ago. If memory serves they have an M Lock handguard that looks pretty interesting. It's probably a little pricey but their stuff has always been top notch.

They probably want the Benelli to sell based on it's reputation and ARGO system and they don't want it to steal sales from the 1301. Or they want them different enough so you'll buy both.

Remington copied the ARGO system and put it in the Versa Max and it's a very soft shooter, so I would guess that the M4 is also a soft shooter.

Should you decide you like the M4 better and don't want to keep (blasphemy, I know) the Beretta, let me know....

I'm at Turner's eyefracking the M4 right now lol. I will probably end up with both. I am a fan of both brands.
