    Henry Lever Action Axe Ca Legal?



    16 in barrel. 26 in overall. .410 ga. Is this Ca legal? Thanks.

    Imma gonna say nyet. No lawyer but the tip off is the short barrel. Perhaps as a AOW?

        Under Ca law it is a short-barreled shotgun because it chambers shotgun shell ammunition and has a barrel of less than 18”.
        This is the same as Contender barrels that will chamber a .410 shot shell.

            Whenever you see this statement you can be assured it won't fly in CA.

                Short answer:

                Nope.

                The Henry Axe can shoot shotgun shells and has a 15.14" barrel length and a 26.4" overall length and no shoulder stock.

                This makes it an illegal firearm in CA.


                Long answer:

                Under Federal laws/regulations...

                The Henry Axe is a Title 1 Other.
                ^Firearm with a less than 16" barrel length and a greater than 26" overall length and no shoulder stock.

                Under CA laws/regulations...

                The Henry Axe is a handgun, short barrel shotgun, unconventional pistol, and unsafe handgun.

                It is a handgun, because it is a firearm with a less than 16" barrel length. [PC 16530(a) & 16640(a)]

                It is a short barrel shotgun, because it is a firearm that can discharge shotgun shells and has a barrel length of less than 18". [PC 17180(a)]

                It is an unconventional pistol, because it is a firearm with a non-rifled barrel and it's barrel length is less than 18". [PC 17270]

                It is an unsafe handgun, because it is a pistol that has not passed CA DOJ safety testing. [PC 31910(b)(1),(2),(3)]

                A firearm that is a BATFE approved Title 2 AOW is exempt from CA SBR/SBS laws and CA unconventional pistol laws [PC 17710(a)], but not exempt from CA unsafe handgun laws.

                Therefore, in order to legally acquire it in CA...

                Option 1. While out-of-state, it is made into a Title 2 AOW and transferred to an exempt person, after the transferee get BATFE approval to transfer (submit Form 4 to transfer, $5 tax stamp).

                Option 2. While out-of-state, it is made into a Title 2 AOW that is modified so that it is considered a dimensionally compliant single-shot pistol and transferred under SSE2, after the transferee gets BATFE approval to transfer (submit Form 4 to transfer, $5 tax stamp). In addition, in order to remain CA legal while in CA, it must be kept as a dimensionally compliant single-shot pistol.

                Option 3. While out-of-state, the 15.14" barrel is replaced with a 18" or greater length barrel. It is then shipped and transferred (ATF 4473 = "other" / CA DROS "long gun, shotgun") to you by a CA FFL dealer. You then make it into a Title 2 AOW (submit Form 1 to make, $200 tax stamp) and once it is BATFE approve, you buy the 15.14" barrel and install it (Federal & CA laws prohibits owning the short barrel with a firearm that can use it, before you get BATFE approval).
