    Pinning a Benelli M4 adjustable stock

    At Turner's today I saw they had Benelli M4s with pistol grips for sale with adjustable stocks. Of course upon asking they said the stock is pinned.

    I currently have a fixed stock on my M4 (as well as a pistol grip). If I were to pin and install my adjustable stock, my understanding is that the shotgun would now be California legal, right?

    My question is this: does it matter where the stock is pinned? There are 3 different lengths to adjust on the Benelli M4 adjustable stock... Can I pin at the shortest length and be California legal?

    To answer your question lets go through the California Penal Code (CPC).



    First the CPC 30515

    (6) A semiautomatic shotgun that has both of the following:
    (A) A folding or telescoping stock.
    (B) A pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, or vertical handgrip.

    (7) A semiautomatic shotgun that has the ability to accept a detachable magazine.

    (8) Any shotgun with a revolving cylinder.

    Following the above guideline, Benelli M4 is a semi auto. So it has to follow #6 where it can have EITHER a pistol grip OR a folding / telescoping stock BUT NOT BOTH.

    CPC 17180 states that a short barrel shotgun has

    a) barrel or barrels of less than 18 inches in length
    b) overall length of less than 26 inches

    So basically measure your shotgun, make sure it's more than 26 inches then pin it.

    Also its been a while since I went through the CPC and I hate the fact that they keep switching the section numbers around.

        AFAIK...

        The Benelli makes both an extending stock and a fixed stock that looks like the extending stock.

        Main difference is the stock tube.
        The extending stock tube has different notches (so the stock can collapse/extend) and the fixed stock tube only has one notch.

          How to pin an M4 collapsing stock

          I pinned mine, I believe in the position one "notch" shorter than fully extended.
          Settle down, folks. The new "ghost gun" regulations probably don't do what you think they do.
