.22LR shotshell smoothbore

Just saw an ad for a Henry "garden gun" a 22 Cal Smooth bore and it looks the business.
It has a 15 round tube magazine..is that legal in CA. Sorry I'm not completely up to date in the regulations here in rimfire.

Under Federal laws...

The Henry Garden Gun is marketed/sold as a Title 1 Shotgun.
Because it has a smoothbore barrel and was designed to use shotshells, it meets the Federal definition of a "shotgun". [18 USC 921(a)(5)]

Under CA laws...

The Henry Garden Gun is considered a CA legal lever-action repeating other firearm that is not a pistol, rifle, or shotgun.
^It does not meet the CA legal definition of a "pistol" [PC 17010 and 16530] or a "rifle" [PC 17090] or a "shotgun" [PC 17190].
~Fixed tubular magazines on lever-action firearms are exempt from CA large capacity magazine laws. [PC 16740(c)]

Therefore...

The Henry Garden Gun would be transferred through a CA FFL dealer as:
~ ATF 4473 = long gun.
~ CA DROS = long gun, other, lever-action.


Also note that...
In order to remain CA legal, the Henry Garden Gun must have a barrel length of 18" or greater and have an overall length of 26" or greater.
If it has a barrel length of less than 18" or an overall length of less than 26", then it will be considered an illegal "unconventional pistol" under CA laws. [PC 31500]

Under CA laws, an "unconventional pistol" is a firearm with a non-rifled barrel that has a barrel length of less than 18" or an overall length of less than 26". [PC 17270]
