M&P 15-22 Performance Center with pinned stock??

First post to the forum but gathered a ton on info before making my buy.

I bought a M&P 15-22 Performance Center locally here in Mountain View CA. When I picked up the gun the stock was pinned. I was under the impression it did NOT need to be pinned to be compliant.

Anyway dealer can't (or won't) exchange it, but is trying to remove the pin. Drilling out my $700+ brand spanking new gun.

My question is will that cause or raise an issue? Un-pinned modded stock in a state where pinning is not needed? Or am I just being parinoid.

Anyway great forum with great info. This is my first gun of any kind so I wanted to make sure I'm legit.

    Thanks in advance . . .

It will not cause an issue. S&W makes that gun for many states and there are some states even more restrictive than CA. They should be able to drill it out no problem. Shoot it and have fun. The standard version of teh same rifle has an adjustable functioning stock. Nothing to worry about.
