AW Law not applicable to rimfire weapons??

    Hey folks,

The question is: do no "assault weapon" laws apply to rimfire riles at all? Particularly the collapsible/folding buttstock, barrel and overall length ones?

Am I legally allowed to have a folding/collapsible buttstock and an overall length of less than 30" on a rimfire rifle in California?

    Thanks much for the clarification

Your OAL with a rimfire must be 26" or greater... REMEMBER: California measures OAL as the length of the firearm in its SHORTEST/SMALLEST possible configuration (I.e., Folded or Collapsed). Also, the muzzle break DOES NOT add to the OAL. Where as the Fed's measure the OAL with the stock extended....

Also, you'll generally get better responses in the Legal Section.

Thanks. I followed the flowchart but was still unclear about OAL limit applying to AW only or not.

        As a follow up:

Does anyone have an approximate measurement from the front of the stock receiver to the trigger? Subsequently, this measurement + the length of the barrel + length of pull of any given butt stock should give the OAL of the rifle. Is that right?

For CA, the muzzle attachment does add length to the OAL.

All you need to know is what the total overall length is from the tip to the back of the rifle with the stock folded/collapsed.

But only if it is permanently attached correct?

I.e., If it's just threaded on it does not count toward the barrel length, so by extension I would think it does not count toward the OAL.

Permanence is not required. Unless, as per Federal laws, it is being done to extended the barrel's length to be 16" or greater.

Your formula is too complicated. Under California law, OAL is determined simply by measuring the length of a rifle while in the shortest possible configuration in which it will fire in. There is no need to add or subtract different measurements to obtain this. As far as Ca AW laws go, I think the flowchart is clear enough, rimfire rifles are exwmpt for Ca AW laws. Rimfire handguns are not. Rimfire shotguns are not exempt either! Remember that OAL applies both to AW laws as well as SBR and SBS laws.

                    Knew that about Barrel Length...

But I've not heard that the muzzle device adds to the OAL even though its not permanent, though I guess its just like buttpads... So, if thats the case... What happens if you have muzzle device that brings the gun over the OAL requirement of 26" and then you go to remove/change it later and while changing it the OAL is under 26"? You then have an illegal configuration (correct)?

So, even if permanence of the muzzle device is NOT required for OAL and your barrel is of a length greater than 16" without the muzzle device... If your relying on the muzzle device to bring you up to the required OAL, that is probably a really bad idea in case you ever need to remove it for any reason.

The same goes for the buttpad on a stock... If you're depending on it to get your OAL and you have to change it out someday.. You could have a problem.

Still, on a Rimfire... The muzzle device will probably not need to factor into the OAL

Pardon the formula, but the purpose is to establish compliance with a certain configuration before actually putting it together. In other words, I'm trying to see if a certain butt stock/barrel combination will come in over the 26" OAL requirement.

I know the barrel length, I know the length of pull for the buttstock, but I dont know the length from the front of the receiver to the trigger. I dont own a ruger 10/22 (yet) and Turner's is far away

Thanks for the information and clarifications! I think if someone could provide a ballpark figure or simply take a ruler to their rifle (Im assuming in the range of 3-5" from receiver front to trigger) it would be immensely helpful. I couldnt find this info elsewhere. Thanks again.

Are we talking about rifles or pistols?

Rimfire pistols are subject to the same AW laws as centerfire pistols:
No 10+ magazines in a fixed configuration, no "evil features" without a fixed magazine, etc....

For rifles, yes... rimfire is exempt and only NFA laws (overall length) apply.

This discussion is only taking into account rimfire rifles. Is anyone able to provide a guess as to the length between the front of a Ruger 10/22 receiver (where barrel meets body) and the trigger?

I used several sources across the internet and came up with approx. 5 3/4". Is this a good estimate? Thanks you, thank you.

5 inches, precisely where the barrel touches the face of the receiver, however some of the barrel inserts into the front of the receiver.
