    Is this gun legal?

In 1962 I bought a Marlin 22 rifle with a tube magazine. Holds 18 22LR and even more if I use shorter rounds. Is this gun legal in CA? I bought it here and it has never left the state.

Great gun. Rarely jams even when I have mixed different length rounds in the tube which I haven't done in years. I taught my son to shoot with it. Shoots nice tight groups.

yes it's legal. One of the exemptions to the large capacity magazine law is tube magazines that feed .22 caliber ammunition.

12020(c)(25) As used in this section, "large-capacity magazine" means any ammunition feeding device with the capacity to accept more than 10 rounds, but shall not be construed to include any of the following:
          (A) A feeding device that has been permanently altered so that it cannot accommodate more than 10 rounds.
          (B) A .22 caliber tube ammunition feeding device.
          (C) A tubular magazine that is contained in a lever-action firearm.

Yup, I own 2 marlin 60's with 17 plus 1 tube mags. They are selling them locally and perfectly legal.

5 round limit if used for hunting right?

I've always wondered if one could manufacture a flexible tube magazine extension with a much higher capacity, perhaps with a pressurized magazine follower.

Not trying to spread FUD but I thought I ended up seeing that there was a defined limit on tube fed, like 14rds or something....

the two main reasons I like the mod 60 marlins is the tube mag holds enough rounds that out hunting I rarely have to reload, and theres no box mag poking me while carying it. Ive had at least one since 1975. DR

Not in California. Another state--I think it was New Jersey--didn't exempt rimfire tube mags from their 15-round limit, which is why current Marlin 60s have a shorter barrel and smaller magazine (14 rounds) than those made in the 1980s and before (18 rounds); for a bit they had the long barrel and short mag tube. I don't remember how many shorts fit in my "18 round" tube, but it's a LOT.

I wish they still made the 18 round one.
