It may be fine at 50 yards. Mark off 50 and 100 yards and take a look. Simple. Good scopes are very flexible. Good glass can make up for a little parallax/focus issue. Just remember some sellers won't take it back after it is mounted so just set it up and look through it. The Muellers are good and have adjustable Objectives.
A 3-9X40 with BDC recticle won't be enough mag or fine enough recticle for really accurate 100 yard shooting. It will be ok at 50 yards but not great. You will want more mag and finer lines. Aim small miss small.

I use a 4-12x40AO to shoot at 50 yards. Like BSlacker said..."aim small, miss small"

Rimfirecentral has instructions on adjusting parallax on non AO scopes. Just a warning it probably voids the warranty. I tried it on the 2-12x simmons I have on my 10/22 and it helped out quite a bit.

Definitely test and see if its necessary first though.

I emailed Nikon and they said they would NOT adjust parallax. They also stated that I could not post their response in an internet forum (fine print on customer service email). So...hypothetically, they might have said this.

But, I have a Nikon 4x32 RF I would trade for your 3-9x40. It's in the parts sale forum. Or, you could find my post history. If your scope is in excl. condition, I would trade straight.

I bought 2 nikon buckmaster 3-9x40 scopes recently and promptly returned them because i hated not having an adjustable objective. I ended up buying 2 bushnell banner 4-12x40 with AO. I already had one of them and like that it adjusts from infinity down to about 10 yards I think.

I thought I was spoiling my 10/22's with the more expensive glass, but the cheaper set worked out better. I wouldnt recommend a nikon without the side focus or adjustable objective. I have the nikon buckmaster 4.5-14x40SF on my HMR and buckmaster 6-18x40SF on my .223

EDIT: I just re-read your post and I wanted to say that I have a Mueller APV on my 17hm2 and I would recommend the Bushnell Banner over the Mueller. The Mueller seems more sensitive to eye position and has a tendency to "blink" at you if you arent in the perfect spot. Like I said above, I have 3 Bushnell Banner 4-12x40's with AO, and 1 Mueller APV. They're close in comparison, but I prefer the Bushnell.
