    legality of Colt .22 rimfire

    The AWB reads:

12276. As used in this chapter, "assault weapon" shall mean the following designated semiautomatic firearms:
    (a) All of the following specified rifles:...
    (5) Colt AR-15 series.
Are the Colt .22 Rimfires legal because the make and model is listed as "Colt M4 Carbine .22 Tactical Rimfire" and not as a Colt AR-15 in .22 rimfire or does AR-15 only include those rifles chambered in 5.56 NATO/.223 Rem? I noticed that the first part of the AWB did not specifically target semi-automatic centerfire rifles like Section 12276.1 does.

AW's are centerfire rifles. Rimfires are not AW's in any configuration.

      Yes.

The 2nd AWB [PC 12276.1] designates semi-auto centerfire rifles, semi-auto pistols & semi-auto shotguns with certain features as AWs.
The 1st AWB [PC 12276] designates certain make/model firearms as AWs.

A .22LR marked as a Colt AR-15, would still be banned in CA. Due to it's make/model matching what's listed.

If I take a Colt M4 .22 Rimfire Carbine and reconfigure it as a 5.56 NATO/.223 Rem rifle (with BB, no FH) have I created an AW?

If that were the case, wouldn't the GSG-5 be banned as well?

If you can do that (I don't believe that would be possible from my brief examination of a sample rifle) then the answer would be yes, in the same manner as if I were to remove the Ciener conversion in my "dedicated" .22LR AR and replace it with the 5.56MM bolt carrier group without first engaging the installed Raddlock.

A semi-auto "Colt M4" is not a Colt AR-15, hence not a named AW. A newly constructed semi-auto centerfire rifle with AW characteristics would be an AW by configuration/"evil features" regardless of what model number is on the lower receiver.

              Colt is not the manufacturer.

Umarex is. It should say that on the receiver.

The "Colt" is just for looks and to trick people into believing that the piece of pot-metal is an actual Colt.

Once again, the Colt is manufactured by Carl Walther, Germany. It is imported by Umarex. It says SO ON THE FRAME. Sheesh, get your facts straight. It is not possible to convert the .22 rimfire Colt to .223 AND since it is a rimfire it is NOT nor will ever be classified as an AW of any kind in California. Lest we forget, S&W is making the Walther PPK/S under license for Walther her in the US, are those guns not "real" Walther guns? Man, some people post just to blow wind out their..............

Tell us about the problems you've had with YOUR Colt....perhaps we Colt.22 owners could help you thru it? I do believe ''aluminum alloy'' is not POT METAL? Perhaps you could explain this to the UNEDUCATED weapon owners out here in the ether.....I'm sure we would all defer to your SUPERIOR knowledge! We are WAITING!!!

I think he only shoots the wasr 22 ak ,because allot of his posts or replies are about the WASR 22 .Some people just prefer one over the other.

                          ??? WTH?

I don't even own a WASR-22. This is probably the first post in my lifetime where I've ever even MENTIONED one.

Anyways, I do still find it funny how angrily people defend their "colt's" when they aren't even Colt's. They're just a low-grade .22 made in Germany from substandard materials and pot-metal.

I've seen them. I've played with them. I'm not impressed.

If that offends people, well that's not my problem. You can keep enjoying your guns, but I'll still laugh when you call them Colt's.

                              No.
Since, it is an OLL and it will have a magazine lock and you will be using 10 round or less magazines in it.

However, the Colt/Umarex/Walther M4 .22LR is not compatible with any type of AR part (except for grips) and the reciever can not handle the pressure of the 5.56x45 or .223Remington cartridge. So, it will be very difficult to convert and if you were able to do so, the rifle most likley KB if you tried to fire it.

                              No.
Because, the German Sport Guns GSG-5 is not make/model listed as an assault weapon.
If the German Sport Guns GSG-5 was marked as a H&K HK-94, then it would be banned as an assault weapon because it matches what's make/model listed.

The OP is correct in his assumption that if the Colt/Umarex/Walther M4 .22LR had been marked Colt AR-15, then it would be banned as a make/model listed assault weapon.
Make/model listed assault weapons are assault weapons because of what's marked on them.
That's why OLL (off-List lowers) are legal because they are not make/model listed.
