I am an OOS FFL and I have a chance to buy a GSG 5 for resale. I know they are legal in CA but I am wondering what rules apply. Any issues with mag capacity or overall length on a rimfire? It has a collapsable stock.

Rimfire essentially has 3 rules. 26" OAL, must meet this length collapsed. minimum 16" barrel (fake can ok as long as it is perminately attached to make up the 16" length) and no more than 10 round capacity in the mag. No problems with the GSG-5 rifles - it's the pistols that get problematic...------------------------------------------------------------

Collapsible stock on a rimfire rifle is okay as long as the OAL of the rifle when the stock is collapsed is greater than 26". And detachable magazines of greater than 10rnds are also okay on rimfire rifles as long as the (non-LEO) owner personally owned that magazine (or a similar type magazine if the magazines has been rebuilt) prior to Jan 1, 2000.
Specifically for the GSG-5 (carbine), most collapsible stocks are okay, most folding are not. And since the GSG-5 didn't exist prior to Jan 1, 2000, it would be sort of hard to convince a court that you owned a hi-cap GSG mag prior to Jan 1, 2000; so although you can legally use a hi-cap magazine in a GSG in CA, in most cases it would be illegal for you to be in possession of the magazine.Last edited by dachan; 06-16-2009, 3:04 PM.Comment
