The barrel of the 22LR upper will be marked as a 22LR and that will satisfy the federal requirements of the caliber being marked somewhere on the gun.
my Spikes ST22 lower is clearly marked "22lr" and unless it's under the hand guard, there is no caliber marking on this dedicated 22lr upper/barrel assembly. it uses no adapter in the magwell other than the Mad dog 22 rimfire magazine. i purchased it new from Spikes via FFL in Temecula.

The markings on the reciever satisfy the marking requirement.
No need to ALSO mark the barrel.
When the whole gun is assembled by a single manufacturer, it's completely acceptable to use the reciever as the place for the caliber marking.

When you sell an upper designed to drop on to an unspecified lowers, the barrel should be marked so that the gun will be compliant when the upper is installed on the unspecified lower BECAUSE an accessory upper manufacturer would not know if there are other marks for 22LR somewhere else on the parts of the gun that the manufacturer has no control over.

I’ve had a Cmmg .22 upper on a “Multi” Mega lower for several years and have always used Black Dog magazines. No mag adapters, and never had a problem with feeding.

Just buy a lower, and don't tell them what you're doing with it. It will only confuse them.
