I found one I want to buy at my LGS question is..... Does the fore end make it an AW?


the fore end is currently on the firearm should it be removed before I take possession?

Yes, it makes it an assault weapon (semi-auto pistol that accepts detachable magazines and has a second handgrip). [PC 30515(a)(4)(B)]

If it uses a fixed 10 round magazine, then it would be CA legal.
If the second handgrip is removed, then it would be CA legal.


Penal Code 30515
(a) Notwithstanding Section 30510, "assault weapon" also means any of the following:
(4) A semiautomatic pistol that has the capacity to accept a detachable magazine and any one of the following:
(A) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
(B) A second handgrip.
(C) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning the bearer's hand, except a slide that encloses the barrel.
(D) The capacity to accept a detachable magazine at some location outside of the pistol grip.
(5) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.

Playing devil's advocate here, but would a licensed California gun dealer really sell a firearm that's illegal in California risking the loose of his/her license and some time behind bars? Does not seem logical to me.

I have a deposit on it. The FFL is waiting for the 30 day consignment period and then I start the Paperwork.

I can't wait to get my Buckmark! I have a Ruger 22/45 SS bull barrel that has only been out once since I bought it. I have had buckmarks before and will probably sell or try and trade the Ruger for another buckmark.

This is my interpretation as well. The handgun AW laws make no distinction for rimfire or not rimfire. The laws apply to all handguns. The wood forward of the grip could be a barrel shroud and/or a forward grip. Either classification makes it an illegal Assault Weapon as per the law.
