First if you paid for brand new and think it's used, Amazon is good at returns. But if all you're concerned about is the warranty, call Eotech and provide them the serial number to get a solid answer. I bought a Kestrel 5700 Elite from Amazon a few weeks ago and it was definitely used at least once. There was a gun profile configured already in the ballistics calculator and the lens film that is put on when it comes off the line was removed. I just requested a replacement and they shipped it out immediately.

I'm quite wary of buying gun parts from Amazon. I've had to return several items in the past because they were fake. I got replica magpul parts that were for airsoft.
