Night vision can be legal in CA, check the sticky thread: http://www.calguns.net/calgunforum/s...d.php?t=851285

That particular optic doesn't appear(at a glance anyway) to have an IR illuminator, meaning it would be legal. As far as use for hunting, that I can't remember off the top of my head and you'd want to go through the DFG regs.

Guess the manager must be Donald O. Johnson.

based on this link, there is a removable IR illuminater, http://www.opticsplanet.com/atn-ares...pon-sight.html

its only "active IR" if it has an IR illuminter. if it has no IR illuminater then it is "passive IR" and then the "sniperscope" definition should not apply to it even though it has magnification.

Do you want an AOW or C&R SBS/SBR in CA?

In this instance, it looks like the illuminator is a separate component that mounts to the side of the scope so all you'd have to do is not mount it. Unfortunately that would also mean you're in possession of a "sniperscope" while it's mounted if it comes in the package that way(I've never seen anything on paper regarding constructive possession of a "sniperscope" due to having an illuminator sitting in the closet).

I'd have to agree. A flash light is the same as an illuminator, it just has a wider array of EMR wavelengths. A light source can be clipped on to any rifle, so I highly doubt constructive receipt would be an issue. Plus, doesn't constructive receipt tend to be more prevalent in federal regulation?

As for coming installed, from my experience, ATN generally ships in a nice container and separates the illuminator if one is provided as their illuminators mount on a side rail and the scopes are typically designed to mount it on either side.

Their G3 or better works well. I'd not get this scope as a much better solution would be to get their PS28 series and use it with your 4x daytime scope. That may cost a bit more, but it would be more versatile.

As a side note, I'd NEVER get anything G2 or better from Walmart. The NV is only as good as the photon intensifier tube, which varies from tube to tube. When they make these units, even at a given level, the better tubes are cherry picked for various purposes. I'd expect that Walmart takes the bottom of the barrel to get the lowest possible price.

I don't think this thread is so much about ATN or NV as it is about the ridiculous nature of someone that would spend $3,000 on a piece of optical gear at Walmart.
