Optics Planet Wont Sell Night Vision Monocles to CA Residents?

Thought I'd share that Optics Planet will not sell night vision monocles to California residents. Apparently they are under the belief that we can't own them.

They stated that because it could be secured to a firearm, California law prohibits such an optic.

I was under the impression we could own night vision.... Maybe I'm wrong?

Yes, they are legal. There is a seriously outdated law with regard to weapon-mounting active IR systems that is likely the cause of confusion. Search for "CA Sniperscope law"

It's actually just in a sticky thread at the top of the forum, no need to even do any searching.

ceedubG, depending on the model(how it's configured) possession can indeed be a problem.

For example, this with it's illuminator is a no-go

The problem with the stupid law and the models I just posted links to, are the IR emitters and magnification. See the above mentioned sticky thread.

edit: Opticsplanet does have someone that uses an account on calguns with the shop name as the user name. Maybe send them a PM with a link to the thread and ask for some clarification? If they can't be bothered to discuss it and the item you want is legal in CA, buy it elsewhere.

So in other words, nightvision scopes with active IR are a problem, but as others here can attest, you shouldn't have any problem acquiring a monocular like a PVS-14.

Thanks for all the input. From what I gather, it does seem as though Optics Planet is relying on outdated or incorrect information.

I ordered an Armasight Sirius Gen 2 SD monocle and the order went through just fine. Then a day later i received an email stating they couldnt sell it due to something about it being restricted by the federal government. Upon calling I learned that it was a California restriction, but the person on the other then of the phone didnt seem to know why.

I then called Armasight directly (a San Francisco based company) and was told that the item I wanted to purchase from OP was legal to own in California.

I also looked up the law CA PC Section 468 which states: sniperscope means any attachment, device or similar contrivance designed for or adaptable to use on a firearm which, through the use of a projected infrared light source and electronic telescope, enables the operator thereof to visually determine and locate the presence of objects during the nighttime.

Sounds like the two main components are (1) IR capability and (2) electronic telescope. The Armasights are not an "electronic telescope. There is no magnification on them (yes, you can buy a magnifier separately). There also is no reticle.

I then contact OP again with the information Armasight provided me, but OP really didnt seem to care. I've purchased so many things from OP in the past and I respect them, but am a little miffed (just a little) that they didnt really want to hear that their risk assessment people were incorrect.

Obviously, I can purchase the Sirius from another vendor (maybe even Armasight directly), but the OP deal was absurdly good! I guess the saying is true, "if it's too good to be true, it probably is"..... Oh well!

This was a mistake in our system that is being corrected. I apologize to ceedubG and anyone else that was inconvenienced by this.

As stated above night vision monoculars should be GTG in California.

Thank you very much for helping me with this issue, I appreciate it. I was contacted very quickly by Optics Planet service department and they fixed the misunderstanding immediately, as well as throwing in a little something for the confusion.

They reiterated that night vision monoculars are legal and they do sell them to all of us cal-gunners.

I have always liked purchasing from OP in the past. Between great prices and quick shipping, Optics Planet was always my first place to search for an item.

And after the way Tim G. & Co. have handled my issue today, I am even more of a fan of Optics Planet.
